延续法统:村规民约对固有习惯法的传承——以贵州省锦屏县平秋镇魁胆村为考察对象

【摘要】：贵州省黔东南苗族侗族自治州锦屏县平秋镇魁胆村的实践表明,村规民约成为传承固有习惯法的主要方式,侗族固有习惯法主要通过村规民约得以传承和弘扬。魁胆村在议定、修改村规民约时,从尊重、选择的原则出发传承良善固有习惯法,延续法统。魁胆村村规民约广泛传承了固有习惯法的观念和规范,具体包括民主机制、族长地位、敬老爱幼、保护妇女、团结互助、热心公益、爱护公物、诚实守信、严禁造谣惑众、禁止内勾外引、吃款处理、喊寨处罚、调解收费等。由于形成了遵守习惯法的传统,村规民约又传承了固有的法统,魁胆村民普遍具有守法遵规意识,严格依约办事,自觉按规行为,魁胆村形成了遵纪守法、遵规守约的良好社会环境。我们应当重视村规民约在传承和弘扬良善习惯法、延续固有法统方面的积极作用,推进全面依法治国的进程。
[Abstract]:The practice of Quidan Village, Pingqiu Town, Jinping County, Southeast Guizhou Province, shows that the village rules and regulations become the main way of inheriting the inherent customary law, and the Dong nationality inherent customary law is mainly passed on and carried forward through the village rules and regulations. Quidan village in the agreement, modify the village rules, from the principle of respect, choice of the inheritance of good and good inherent customary law, the continuation of the legal system. The rules and regulations of Quidan Village have widely inherited the concepts and norms of inherent customary law, including democratic mechanisms, patriarchal status, respect for the elderly and children, protection of women, solidarity and mutual assistance, enthusiasm for the public good, care for public property, honesty and trustworthiness, and strictly prohibiting spreading rumors and misleading people. It is prohibited to quote inside and outside, eat money, call for punishment, mediation fees and so on. As a result of the tradition of obeying customary law, the village rules and regulations have passed on the inherent legal system. The villagers of Quidan generally have a sense of abiding by the law, act strictly by the rules, act according to the rules, and the village of Quidan has formed a system of abiding by the law. A good social environment for compliance and compliance. We should attach importance to the positive role of village rules and regulations in inheriting and carrying forward the good and good customary law, continuing the inherent legal system, and promoting the process of ruling the country according to law in an all-round way.
