【摘要】：行政约谈作为时下解决行政监管领域难题的创新手段，被广泛运用到了行政管理的各个领域，并取得了显著的成效。通过概念、要素、运行、作用四个方面对行政约谈的内涵与外延进行分析，发现行政政约谈在实践中仍存在适用、效力、异化的问题及辩诉交易、反法治化的倾向，主要原因是立法位阶低、程序规范欠缺、配套机制不健全、执法人员认识不足。为了解决上述问题，从理论上，，把行政约谈界定为以动态方式实现行政目的并具有独立价值的“一般性制度”；并从实体法规制、程序法规制、救济途径选择三个方面提出行政约谈法治化建议，以期构建行政约谈法治化、规范化的基本框架。
[Abstract]:As an innovative means to solve the difficult problems in the field of administrative supervision, administrative interview has been widely used in various fields of administrative management, and has achieved remarkable results. Through the analysis of the connotation and extension of the administrative interview in four aspects of concept, element, operation and function, it is found that the administrative interview still has the problems of applicability, effectiveness, alienation and the tendency of plea bargaining and anti-legalization in practice. The main reasons are low legislative level, lack of procedural norms, imperfect supporting mechanism and insufficient understanding of law enforcement officers. In order to solve the above problems, in theory, the administrative interview is defined as the "general system" which realizes the administrative purpose in a dynamic way and has independent value, and it is regulated by the substantive law and the procedural law. In order to construct the basic frame of the rule of law and standardization of administrative interview, three aspects of the choice of relief ways are put forward.
