我国集体合同主体法律问题研究

【摘要】:集体合同制度在17世纪末于英国确立以来,因其在调整和稳定劳资关系,缓和劳资矛盾,营造和谐社会环境具有积极意义,在世界各国得到了充分发展。我国《工会法》(1950)亦对集体合同制度进行了相应规定。然而需要指出的是,目前我国法律对集体合同的相关规定尚不完善,且规定的可操作性差、追责机制不健全。权利能力的不明确导致集体合同主体在实践中存在行为能力上的短板。最终使得我国集体合同制度在现阶段并没能完全实现其目标价值。因此,集体合同制度在保障劳动者权益、构建和谐劳动关系方面仍有很大的可塑空间。集体合同签订和履行的基础是集体合同主体。为了继续挖掘集体合同制度的潜力,需要完善对集体合同主体的法律规定,理清集体合同主体的权义结构,规范劳资双方在集体合同中的行为,提高集体合同主体的权利能力和行为能力。因此本文拟以集体合同主体为视角,从立法和实践两个层面分析我国现行法律中集体合同主体存在的问题,并在借鉴德、日、美三国集体合同主体相关规定的基础上,从劳方主体、资方主体及劳动行政部门三个角度提出对我国集体合同主体法律问题完善的建议。
[Abstract]:Since the establishment of the collective contract system in England at the end of the 17th century, the collective contract system has been fully developed in the world because of its positive significance in adjusting and stabilizing the labor relations, easing the contradiction between labor and capital, and creating a harmonious social environment. The Trade Union Law of China (1950) also provides for the system of collective contract. However, it is necessary to point out that at present, the relevant regulations of collective contract in our country are not perfect, and the operation of the provisions is poor, and the mechanism of pursuing responsibility is not perfect. The ambiguity of the right ability leads to the deficiency of the collective contract subject's behavior ability in practice. Finally, the system of collective contract in our country has not fully realized its target value at the present stage. Therefore, the collective contract system still has a lot of room for protection of workers' rights and interests and construction of harmonious labor relations. The basis of signing and performing collective contract is the subject of collective contract. In order to continue to tap the potential of the collective contract system, it is necessary to perfect the legal provisions on the subject of the collective contract, clarify the structure of the right and meaning of the subject of the collective contract, and standardize the behavior of both employers and employees in the collective contract. Improve the collective contract subject's right ability and the behavior ability. Therefore, from the perspective of the subject of collective contract, this paper analyzes the problems existing in the subject of collective contract in the current law of our country from the two aspects of legislation and practice, and on the basis of drawing lessons from the relevant provisions of the subject of collective contract in Germany, Japan and the United States. This paper puts forward some suggestions on how to perfect the legal problems of the subject of collective contract in our country from three angles: the main body of labor, the subject of management and the administrative department of labor.
