云计算时代我国网络舆情引导法律机制的构建

【摘要】：云计算时代网络舆情引导法律机制的研究，是将网络舆情的研究置于与计算时代的社会背景下，力求得出与时代相适应的网络舆情引导法律机制的构建方式。网络舆情是通过互联网表达和传播的各种不同情绪、态度和意见交错的总和。目前，我国正处于社会转型的关键时期，网络舆情的引导面临着各种各样的问题，这不仅影响着我国网络舆情的良性发展，也影响着我国民主化进程以及社会的和谐稳定。本文从云计算时代网络舆情的内涵界定出发，深入探讨舆论、舆情、民意的概念，从而得出云计算时代网络舆情的应有之义，在确定了论题的理论范畴之后，结合我国网络舆情引导机制的现状以及域外考察的启示，进一步研究云计算时代网络舆情引导法律机制的构建应具备的制度基础，即政府信息公开与政务透明化，公民言论自由、新闻传播权等私权利的保障等配套制度基础。在以上循序渐进的研究的基础之上，探讨我国网络舆情引导法律机制构建的立法完善，，主要从完善网络媒体规范法律制度出发，建立国家级网络舆情检测云平台运行的法律机制，并在此平台上构建网络舆情信息分级预警机制。
[Abstract]:The research on the legal mechanism of network public opinion guidance in cloud computing age is to put the research of network public opinion under the social background of the computing era and try to get the construction method of the network public opinion guiding legal mechanism which is adapted to the times. Internet public opinion is the sum of different emotions, attitudes and opinions expressed and transmitted through the Internet. At present, our country is in the critical period of social transformation, the guidance of network public opinion is facing a variety of problems, which not only affects the benign development of China's network public opinion, but also affects the democratization process and social harmony and stability. This article starts from the cloud computing era network public opinion connotation definition, deeply discusses the public opinion, the public opinion concept, thus obtains the cloud computing time network public opinion due meaning, after has determined the topic theory scope, Combined with the current situation of the guiding mechanism of network public opinion in our country and the enlightenment of overseas investigation, this paper further studies the institutional basis for the construction of the legal mechanism of network public opinion guidance in cloud computing era, that is, government information openness and transparency of government affairs. Civil freedom of speech, the right to spread news and other private rights protection and other supporting system basis. On the basis of the above step by step research, this paper probes into the legislative perfection of the legal mechanism guided by the network public opinion in our country, mainly from the view of perfecting the legal system of the network media standardization. The legal mechanism of network public opinion detection cloud platform is established, and the hierarchical warning mechanism of network public opinion information is constructed on this platform.
