食品安全内部举报法律制度研究

【摘要】:食品安全是民之根本,食品安全问题关系到社会生活的各个方面。如今社会,食品安全问题却屡见不鲜,各种各样食品安全问题的出现,为我们敲响警钟。食品安全作为特殊的领域,具有影响范围广、后果严重性强等特点,因此必须加强食品安全监管。为了解决食品安全监管中存在的问题,必须加强对食品安全监管体系的研究力度。完善我国的食品安全监管机制,不能仅仅依靠有限的政府监管部门,而是需要发挥社会公众的力量,通过调动社会公众的监督积极性,扩大监督的力度和深度。在社会公众的监督队伍中,食品安全内部举报人则具有优势地位,内部举报人能够更加清楚地了解食品安全行业中所存在的问题,对及时发现食品安全领域的违法行为,避免食品安全问题的出现具有重要意义。本文主要研究食品安全内部举报法律制度,首先介绍食品安全内部举报法律制度的基本理论。通过对食品安全内部举报法律制度概念、法律属性、法理基础以及意义的描述,对食品安全内部举报法律制度形成初步的了解,所谓的食品安全内部举报法律制度即食品安全问题的知情人士,对其所知悉的“内幕”向食品安全监管部门进行举报,有关部门给与相应奖励并提供全方位保护的制度。此制度与域外“吹哨人”制度具有相同的意义。因此,本文通过介绍美国、英国、日本关于“吹哨人”的相关制度,借鉴国外对于“吹哨人”制度的基本制度、奖励制度、保护措施、救济程序的相关规定,进一步完善我国的食品安全内部举报法律制度。通过研究国外“吹哨人”制度以及我国食品安全内部举报制度的法律现状,包括食品安全内部举报制度的立法、实践、实施效果等,发现我国食品安全内部举报法律制度中出现的问题,包括内部举报基本制度有所欠缺、奖励制度较为不健全、保护措施尚有不足、救济程序不顺畅四个方面。最后,本文针对我国食品安全内部举报法律制度中存在的问题,提出了四方面的完善建议,包括完善食品安全内部举报的基本制度、健全奖励制度、加强保护制度以及改进救济机制。本文认为真正决定内部举报人是否提供举报信息的关键是政府能够提供有效的保护,而奖励措施只能作为其中一种激励手段,本制度的重点措施是对内部举报人的保护。为内部举报人提供贯穿始终、全程有效的保护措施,为内部举报人实施举报解决后顾之忧,真正发挥食品安全内部举报制度的重要意义。
[Abstract]:Food safety is the root of the people, food safety issues related to all aspects of social life. Nowadays, the problem of food safety is common, and the emergence of all kinds of food safety problems is a wake-up call for us. Food safety, as a special field, has the characteristics of wide range of influence and severe consequences, so it is necessary to strengthen the supervision of food safety. In order to solve the problems existing in food safety supervision, we must strengthen the research on food safety supervision system. In order to perfect the food safety supervision mechanism of our country, we should not only rely on the limited government supervision department, but also need to give play to the power of the public and expand the intensity and depth of the supervision by arousing the enthusiasm of the public. In the supervisory team of the public, the internal informants of food safety have an advantageous position. The internal whistleblowers can understand more clearly the problems existing in the food safety industry, and timely discover illegal activities in the field of food safety. It is of great significance to avoid food safety problems. This article mainly studies the food safety internal report legal system, first introduces the food safety internal report law system basic theory. Through the description of the concept, legal attributes, legal basis and significance of the food safety internal reporting legal system, the preliminary understanding of the food safety internal reporting legal system is formed. The so-called internal reporting legal system of food safety, that is, the informed person of food safety problem, reports the "insider" to the food safety supervision department, and the relevant department gives the corresponding reward and provides the omni-directional protection system. This system has the same meaning as the overseas "whistler" system. Therefore, by introducing the relevant systems of "whistler" in the United States, Britain and Japan, this paper draws lessons from the relevant provisions of the basic system, the reward system, the protection measures and the relief procedures of the "whistler" system in foreign countries. Further improve our food safety internal reporting legal system. By studying the foreign "whistle-blowers" system and the current legal situation of the food safety internal reporting system in China, including the legislation, practice and implementation effect of the food safety internal reporting system, The problems in the internal reporting legal system of food safety in China are found, including the deficiency of the basic internal reporting system, the imperfect reward system, the insufficient protection measures and the unsmooth relief procedure. Finally, in view of the problems existing in the internal reporting legal system of food safety in China, this paper puts forward four suggestions for perfection, including perfecting the basic system of internal reporting of food safety, and perfecting the reward system. Strengthen the protection system and improve the relief mechanism. This paper holds that the key to decide whether internal whistleblower provides information is that the government can provide effective protection, and the incentive measures can only be used as one of the incentives, and the key measure of this system is the protection of internal whistleblowers. To provide effective protection measures throughout the whole process for internal whistleblowers, to solve the concerns of internal whistleblowers, and to give full play to the important significance of food safety internal reporting system.
