政府信息公开中的公民权利救济研究

【摘要】：2014年10月20日-23日,中共十八届四中全会在京举行,会议把“依法治国”作为主题,在党的历次中央全会上还是第一次,其意义重大,反响很强烈。会议通过一个重要决定,为全面推进依法治国设置了总目标、五个体系和六项重要任务。尤其是在法治政府环节,将政务公开作为专门任务提了出来,展现了党和国家建设法治国家、法治政府、法治社会的勇气和信心,赢得国内外一致好评。本文是在这样的背景下研究政府信息公开救济机制的。我国政府信息公开制度起步较晚,在2007年国务院才制定《中华人民共和国政府信息公开条例》,为政府信息公开提供了行政法规层面上的依据。政府信息公开制度不成熟,尤其是救济制度的不完善,使公民合法权益得不到充分保障。本文以政府信息公开中的公民权利救济的理论为基础,对现有法律规范和实践中对信息公开中公民权利救济现状的分析,找出救济的缺陷,观察域外救济途径,借鉴其中有利的经验,从而提出完善我国信息公开救济的建议。本文分为引言、主体、结语三部分。在主体部分,分为五大块。第一,对政府信息公开权利救济总体上进行概述。分别阐述了政府信息公开中的公民权利救济的概念和意义。第二,分析我国政府公开救济的现状和存在的问题。首先,依次介绍举报、行政诉讼、行政复议和行政赔偿四种救济途径。并对这几种途径存在问题加以分析。其次,分析实践中的政府信息公开救济的现状及存在的问题。第三,分析我国政府公开救济中问题产生的原因。包括观念和立法的原因。第四,研究域外对政府信息公开救济制度的规定。通过研究美国、英国、日本的相关制度,总结其特点,得到经验和启发。第五,文章的重点,着重介绍如何促进政府信息公开中的公民权利救济。
[Abstract]:From 20 to 23 October 2014, the fourth Plenary session of the 18th CPC Central Committee was held in Beijing. The meeting took "governing the country according to law" as the theme. The meeting adopted an important decision, setting general objectives, five systems and six important tasks for comprehensively promoting the rule of law. Especially in the link of government by law, the publicity of government affairs is put forward as a special task, which shows the courage and confidence of the party and state in building a country ruled by law, a government ruled by law and a society ruled by law, and has won unanimous praise at home and abroad. In this context, this paper studies the relief mechanism of government information disclosure. The opening system of government information in our country started late. In 2007, the State Council formulated the regulations of the people's Republic of China on the publicity of Government Information, which provided the basis for the publicity of government information at the level of administrative laws and regulations. The immaturity of government information disclosure system, especially the imperfection of relief system, makes the legal rights and interests of citizens not fully protected. Based on the theory of civil rights relief in the publicity of government information, this paper analyzes the current situation of the relief of civil rights in the current legal norms and practices, finds out the defects of the relief, and observes the ways of relief outside the country. Draw lessons from the beneficial experience, and put forward suggestions to improve the relief of information disclosure in China. This article is divided into three parts: introduction, subject and conclusion. In the main part, it is divided into five chunks. First, the relief of the right of government information disclosure is summarized. This paper expounds the concept and significance of civil right relief in the publicity of government information. Second, analyze the current situation and existing problems of our government's open relief. First of all, it introduces four kinds of remedies: reporting, administrative litigation, administrative reconsideration and administrative compensation. The existing problems of these ways are analyzed. Secondly, the paper analyzes the current situation and existing problems of public relief of government information in practice. Third, analyze the causes of the problems in our government's open relief. Including the reasons for ideas and legislation. Fourth, the study of the extraterritorial relief system of government information disclosure provisions. Through the study of the relevant systems of the United States, Britain, Japan, summed up its characteristics, and gained experience and inspiration. Fifth, the article focuses on how to promote the relief of civil rights in the publicity of government information.
