高校聘任制下教师解聘法律问题探析——由湖南大学教授解聘事件引发的讨论

【摘要】:高校聘任制改革是我国高校管理改革的趋势,也是一项复杂的工程,在此过程中暴露出一系列的问题,湖南大学教授解聘事件即是近年我国高校聘任制改革中出现的一起典型案例。从湖南大学教授解聘事件可以看出,高校聘任制改革中出现的主要问题是相关法律规范缺失、权力行使程序不完善、权利救济渠道不畅所致。高校聘任制改革的继续推进离不开相关法律法规和制度的完善,建议有关部门从国家顶层设计出发,对高校教师聘任合同的法律性质、高校教师解聘权的行使以及高校教师被解聘的法律救济三个方面的制度予以完善,以使我国的高校聘任制改革能够在兼顾效率与公平的前提下良性运转。
[Abstract]:The reform of employment system in colleges and universities is the trend of management reform in colleges and universities in China, and it is also a complex project. In this process, a series of problems have been exposed. The dismissal of professors in Hunan University is a typical case in recent years in the reform of employment system in colleges and universities in China. It can be seen from the dismissal of professors in Hunan University that the main problems in the reform of the employment system in colleges and universities are the lack of relevant legal norms, imperfect procedures for the exercise of power, and lack of channels for relief of rights. The promotion of the reform of the employment system in colleges and universities is inseparable from the perfection of relevant laws, regulations and systems. It is suggested that the relevant departments should proceed from the top level design of the country and study the legal nature of the employment contracts for teachers in colleges and universities. In order to make the reform of the employment system in colleges and universities work well on the premise of both efficiency and fairness, the exercise of the right to dismiss university teachers and the legal relief of teachers being dismissed will be perfected.
