社团规章的治理逻辑与法治依赖

【摘要】：社团规章作为社团自治的内生性规则,其主要借助沟通协同、共识凝聚而成为自我立法、民主协商、社会资本积累等多元价值实现的重要治理动力。在治理机理上,社团规章能够平衡社团治理中交织的权利和利益,提升社团治理主体关系的交涉性,促进社团治理自生秩序的形成,增强社团治理的民主合法性基础。法治是治理的基本要求,在治理过程中,社团规章必须透过法治保证其治理的科学性和有效性。法治可以为社团规章治理注入公法原则,能为社团规章科学设计责任分摊体系以及防范社团规章治理失灵。
[Abstract]:As an endogenous rule of association autonomy, association regulation has become an important governance power for the realization of multiple values, such as self-legislation, democratic consultation, social capital accumulation and so on, by means of communication and coordination, consensus agglomeration and so on. In terms of governance mechanism, the rules of association can balance the rights and interests intertwined in corporate governance, enhance the bargaining nature of the relationship between the main bodies of corporate governance, promote the formation of self-order of community governance, and strengthen the democratic legitimacy basis of corporate governance. The rule of law is the basic requirement of governance. In the process of governance, the rules of association must guarantee its scientific and effective governance through the rule of law. The rule of law can inject the principles of public law into the governance of association regulations, can scientifically design the system of sharing responsibility for the rules of association and prevent the failure of governance of the rules of association.
