比较法视域下的我国法定“公共档案”定义方法探析

【摘要】：借鉴外国档案法律法规对"公共档案"定义的经验,总结外国法定"公共档案"定义的共性和差异,分析各国在定义"公共档案"的所有权归属倾向、立法定位、保存与管理主体的确立,以及保存时间和公开利用限制的规定等5个方面产生差异的原因,在此基础上,从形成者与形成过程、价值、特点、属概念以及与其他法律法规协调等5个方面对定义我国"公共档案"的方法提出建议。
[Abstract]:Drawing lessons from the experience of the definition of "public archives" in foreign countries, this paper sums up the commonness and differences of the definition of "public archives" in foreign countries, and analyzes the ownership tendency and legislative orientation of the definition of "public archives" in various countries. On the basis of the establishment of the main body of preservation and management, as well as the regulations of the preservation time and the restriction of public utilization, the reasons for the differences are discussed. On this basis, from the aspects of formative and formative process, value, characteristics, etc. This paper puts forward some suggestions on the definition of "public archives" in our country from five aspects, namely, the concept of "public archives" and the coordination with other laws and regulations.
