【摘要】：我国是遭受自然灾害的影响非常严重的国家,而且具有灾害的种类非常多,发生频率非常高,涉及的地域和空间非常广等特点,严重影响社会的健康有序发展。研究分析现有观点,笔者认为自然灾害行政救助指的是国家公民因自然灾害的突然袭击,其基本生活无法得到有效保障、本人和家属的生命权受到严重威胁时,国家或政府给予其物质帮助或者与物质有关的生活及权益帮助的国家或政府具体行政行为。目前,我国在自然灾害行政救助方面的立法有《突发事件应对法》的相关内容、针对个别自然灾害的行政法规、规章和地方性法规、《自然灾害救助条例》、《国家自然灾害救助应急预案》以及国家和各省份制定的突发事件应急预案等,共同构成了我国自然灾害行政救助法制体系。通过对自然灾害行政救助的基本理论和现行法制体系进行分析,可以看出我国的自然灾害行政救助在立法统一和相关制度方面存在着不足之处。文章主要想通过剖析国内相关法制情况和洞察国外相关有益经验做法的基础上,提出完善我国自然灾害行政救助法律制度的建议。文章共三部分,第一部分梳理了自然灾害行政救助的概念、特征以及自然灾害行政救助法律制度产生的基础；第二部分在观察自然灾害行政救助主要法律关系的基础上,介绍了我国的立法现状,并对目前自然灾害行政救助法律制度存在的主要缺陷进行了详尽分析；第三部分在了解和剖析国外自然灾害行政救助的现行法律制度状况、借鉴其有益经验做法下,针对我国自然灾害行政救助法律制度存在的不足,从多方面提出了改善建议。
[Abstract]:China is a country seriously affected by natural disasters, and has many kinds of disasters, very high frequency, involving a wide range of regions and space, seriously affecting the healthy and orderly development of society. After studying and analyzing the existing viewpoints, the author thinks that the administrative relief of natural disasters refers to the situation when the national citizen's basic life cannot be effectively protected because of the sudden attack of natural disasters, and the right to life of his or her family members is seriously threatened. The specific administrative act of a state or government that gives it material aid or life and rights related to material assistance. At present, our country's legislation on administrative relief for natural disasters has the relevant contents of the "Emergency response Law," aiming at the administrative regulations on individual natural disasters. Regulations and local regulations, "regulations on natural disaster relief", "national natural disaster relief emergency plan", and the emergency plan formulated by the state and the provinces constitute the legal system of administrative relief of natural disasters in our country. Through the analysis of the basic theory of administrative relief of natural disasters and the current legal system, we can see that there are some deficiencies in the unification of legislation and the related system of administrative relief of natural disasters in our country. Based on the analysis of the domestic legal system and the experience and practice of foreign countries, this paper puts forward some suggestions to perfect the legal system of administrative relief of natural disasters in China. The first part combs the concept and characteristics of administrative relief of natural disasters and the foundation of the legal system of administrative relief of natural disasters. The second part is based on the observation of the main legal relations of administrative relief of natural disasters. This paper introduces the present legislative situation of our country, and analyzes in detail the main defects existing in the current legal system of administrative relief of natural disasters. The third part is to understand and analyze the current legal system of administrative relief of natural disasters in foreign countries. In the light of its beneficial experience and practice, this paper puts forward some suggestions to improve the legal system of administrative relief of natural disasters in China.
