我国行业协会对市场监管的法律问题研究

【摘要】:在政府职能转变和行业协会与政府主管部门脱钩试点的大背景下,政府对市场监管的权力正在逐步下放,而作为非政府组织代表的行业协会成为了承接市场监管职能的主体之一。行业协会监管是弥补市场、政府“双重失灵”的有效手段,本文在参考国内外学者研究的基础上,对行业协会市场监管的合理性、合法性以及现状进行理论分析,并通过借鉴域外先进监管制度,对我国行业协会市场监管的完善提出可行性完善建议。本文共分为四章,依次对行业协会市场监管的权力来源及实施、现状介绍、困境分析、完善建议等问题展开探析,主要内容如下:第一章为文章研究的基础理论,从行业协会市场监管的基本概念及监管主体着手,以第三部门管理理论为监管权的来源基础,以“市场失灵”和“政府失灵”为现实需求,采用跨学科研究方法,综合法学、管理学、社会学等多学科理论基础,阐述行业协会市场监管的合理性及必要性。第二章为对行业协会市场监管权展开深入分析。首先对监管权的来源进行理论剖析,分为法律授权、政府委托和会员让权三种权力来源路径;再次对监管权的实施进行探讨,主要围绕市场准入、行业规范及行业标准的制定及解决争端等实务问题展开。第三章主要针对行业协会市场监管现状展开分析,提出我国行业协会存在监管合法性不足、政会分离不到位、自律监管机制不完善及滥用市场监管权等障碍。采用比较分析方法,通过对国外行业协会市场监管经验的研究,提炼出行业协会市场监管应纳入立法层面、政府应转变单一监管模式、充实协会经费来源及合理扩大行业协会职权等四种解决路径。第四章则是在前三章的分析基础上,对行业协会市场监管的现实障碍提出系统性完善意见,在市场监管主体层面,为解决监管合法性不足的障碍,提出加快行业协会市场监管立法进程的完善建议;在监管职责层面,为解决政会分离不到位的障碍,提出平衡行业协会监管与政府监管的关系的处理路径;在行业协会监督层面,为解决行业协会市场监管权滥用的障碍,提出对内优化自律机制,对外加强社会监督的解决方式。
[Abstract]:In the context of the transformation of government functions and the pilot decoupling of trade associations from government authorities, government powers over market regulation are gradually being decentralized. As a non-governmental organization representative, the industry association has become one of the main bodies to undertake the function of market supervision. The regulation of trade association is an effective means to make up the market and the government "double failure". Based on the research of scholars at home and abroad, this paper makes a theoretical analysis of the rationality, legitimacy and present situation of the supervision of trade association market. By using the foreign advanced supervision system for reference, the paper puts forward some feasible suggestions to improve the market supervision of China's trade associations. This paper is divided into four chapters, in turn to the power sources and implementation of market supervision of industry associations, the introduction of the current situation, predicament analysis, perfect suggestions and other issues, the main contents are as follows: the first chapter is the basic theory of the article. Starting from the basic concept and main body of market supervision of trade association, taking the management theory of the third sector as the source of supervision right, taking "market failure" and "government failure" as the realistic demand, adopting the interdisciplinary research method, comprehensive law, This paper expounds the rationality and necessity of the market supervision of trade associations on the basis of multi-disciplinary theories such as management and sociology. The second chapter is an in-depth analysis of the market regulatory power of industry associations. First of all, the source of regulatory power is analyzed theoretically, which is divided into three power sources: legal authorization, government entrustment and member transfer power. Thirdly, the implementation of regulatory power is discussed, mainly around market access. Industry standards and industry standards for the formulation and settlement of disputes and other practical issues. The third chapter mainly analyzes the current situation of market supervision of trade associations, and points out that there are some obstacles such as insufficient legality of supervision, lack of separation of government, imperfect mechanism of self-regulation and abuse of market supervision power in China. By using the comparative analysis method, through the research on the experience of foreign trade association market supervision, it is concluded that the industry association market supervision should be brought into the legislative level, and the government should change the single supervision mode. Enrich the fund source of the association and reasonably expand the authority of the trade association four ways to solve the problem. On the basis of the analysis of the first three chapters, the fourth chapter puts forward systematic and perfect opinions on the practical obstacles of the market supervision of the industry association, in order to solve the obstacles of insufficient legitimacy of the supervision at the level of the main body of the market supervision. The paper puts forward some suggestions on how to speed up the legislative process of market supervision of trade associations, and puts forward a way to balance the relationship between the supervision of trade associations and the supervision of government in order to solve the obstacles of the separation of government and trade associations. At the level of trade association supervision, in order to solve the obstacle of the abuse of market supervision power of trade association, the author puts forward the solution of optimizing self-discipline mechanism and strengthening social supervision.
