行政法视域下中小学非教育教学时间学生安全保障研究

【摘要】：中小学校是未成年学生接受教育的机构和场所,学校安全关系到每一位学生的身心健康发展。近年来,中小学校的学生安全已经成为全社会普遍关注的社会热点问题之一,也启发了众多学者从多学科理念、多领域视角、运用综合理论知识进行研究。从目前的研究现状看来,中小学非教育教学时间的学生安全保障是一个值得探寻和研究的新问题,可以作为一项重要实践将其深入到教育法治和教育管理中去。目前,我国有关学生安全保障的法律资源极为匮乏,非教育教学时间学生安全保障的立法规制更是几近空白,这对相应的行政实践与司法实践极为不利。因此,有必要将非教育教学时间学生安全保障问题置于教育法治背景之下,将其纳入现有学校安全法规中,使其成为其中重要篇章,建立起一套完善的安全管理和保障制度。基于中小学校的公共安全属性,笔者以行政法学的视野,联系应然、规范、实然三种维度作为本课题的研究进路。具体而言,本文的研究分为三大部分,首先是对中小学非教育教学时间学生安全保障进行理论梳理,包括对有关概念进行解析、对学生安全保障主体的法律关系进行分析、提出学生安全保障的相关理论基础。其次是从实践的角度对非教育教学时间的现状和问题缺陷进行反思。最后结合理论梳理和实践反思,从法治保障的角度提出将非教育教学时间学生安全保障纳入立法并构建相应制度。笔者结合宏观思路和具体制度设计,以管理预防到安全责任追究为贯穿主线,进行相关制度的探索,以求得出可供立法工作者与理论研究者参考、借鉴的有益观点。
[Abstract]:Primary and secondary schools are institutions and places for underage students to receive education. School safety relates to the physical and mental development of every student. In recent years, the safety of students in primary and secondary schools has become one of the social hot issues that the whole society pays close attention to, and has inspired many scholars to study from the perspective of multi-disciplinary concepts and fields, using comprehensive theoretical knowledge. From the current research situation, the safety and security of students in non-educational teaching time in primary and secondary schools is a new problem worth exploring and studying, and it can be taken as an important practice to go deep into the educational rule of law and education management. At present, the legal resources of students' safety and security in our country are extremely scarce, and the legislative regulation of students' safety and security in non-educational teaching time is almost blank, which is extremely disadvantageous to the corresponding administrative and judicial practice. Therefore, it is necessary to put the problem of students' safety and security in non-educational teaching time under the background of educational rule of law, to bring it into the existing school safety laws and regulations, to make it an important chapter, and to establish a set of perfect safety management and security system. Based on the public safety attribute of primary and secondary schools, the author takes the administrative law as the research approach. Specifically, the research of this paper is divided into three parts. Firstly, the theoretical analysis of students' safety and security in non-educational teaching time in primary and secondary schools, including the analysis of relevant concepts, the analysis of the legal relationship of students' safety and security subject. Put forward the relevant theoretical basis of student safety and security. Secondly, it reflects on the current situation and defects of non-educational teaching time from the perspective of practice. Finally, combining the theory and practice reflection, from the point of view of the guarantee of rule of law, the author puts forward to bring the security of non-educational teaching time students into the legislation and construct the corresponding system. Combined with the macroscopic thinking and the concrete system design, the author takes the management prevention and safety responsibility investigation as the main line, carries on the related system exploration, in order to obtain the beneficial viewpoint which can be used for reference by the legislator and the theory researcher.
