我国转基因食品标识制度法律问题研究

【摘要】:转基因生物技术的问世和发展可以算得上是20到21世纪最具前景的科技进步之一,转基因食品的出现给困扰人类已久的粮食短缺问题的解决带来了曙光。然而,对大部分人来说,转基因食品仍然是一个新兴的概念。面对市场上种类繁多的转基因食品,消费者往往需要借助一定的方式来从中获取信息。尤其是在转基因食品安全性尚无定论的情况下,对相关信息的公开就显得尤为重要。因此,出于保护消费者知情权、保障转基因食品安全监管的目的,转基因食品标识制度应运而生,成为世界各国、各地区对转基因食品进行安全监管的重要手段之一。2002年,我国初步建立了转基因食品标识制度,规定对转基因食品进行强制标识。然而,随着时间的推移,现有的立法己经不能有效解决转基因食品的标识管理问题,我国转基因食品标识制度的问题也在日渐暴露。为此,我们需要结合当今国际形势及我国的具体国情,进一步完善我国转基因食品标识制度。 本研究主要从以下四个方面展开论述: 第一部分,从转基因食品的概念着手,对转基因食品的内涵、转基因食品标识的内涵和类别进行了详细的分析,着重分析了转基因食品的潜在安全性问题及转基因食品标识制度的存在根基。 第二部分,梳理我国转基因食品标识制度的立法现状,明确转基因食品标识制度确立的制度内容,进而分析了我国转基因食品标识制度存在的不足。 第三部分,对国外转基因食品标识制度的立法现状进行考察,梳理典型国家对转基因食品标识制度的基本理念、监管主体、具体法律规定等内容,通过对不同制度的比较,得出国外转基因食品标识制度对我国的启示。 第四部分,针对目前我国转基因食品标识制度所存在的不足,着重从完善转基因食品标识的可操作性细则、规范转基因食品标识的内容、范围及形式、优化监管主体和健全相关配套制度等方面提出完善我国转基因食品标识制度的法律对策。
[Abstract]:The advent and development of genetically modified biotechnology can be regarded as one of the most promising advances in science and technology in the 20th to 21st century. The emergence of genetically modified food has brought dawn to the solution of the problem of food shortage that has plagued mankind for a long time. For most people, however, GM food is still a new concept. In the face of a wide variety of genetically modified foods in the market, consumers often need to obtain information from them in a certain way. Especially in the case of GM food safety is not conclusive, the disclosure of relevant information is particularly important. Therefore, for the purpose of protecting consumers' right to know and ensuring the safety supervision of genetically modified foods, the labelling system of genetically modified foods has emerged as the times require, and has become one of the important means for the safety supervision of genetically modified foods in all countries and regions in the world. In 2002, China has initially established a genetically modified food labeling system, prescribing mandatory labelling of genetically modified foods. However, with the passage of time, the existing legislation has not been able to effectively solve the issue of GM food labeling management, and the problem of GMF labeling system in China has been exposed day by day. Therefore, we need to further improve the labelling system of genetically modified foods in China in the light of the current international situation and the specific conditions of our country. This study is mainly discussed from the following four aspects: the first part, from the concept of genetically modified food, The connotation of GM food, the connotation and category of GMF labeling are analyzed in detail, and the potential safety of GMF and the foundation of GMF labeling system are analyzed in detail. The second part, Combing the legislation status of transgenic food labeling system in China, clarifying the content of the system, and then analyzing the shortcomings of the labelling system of transgenic food in China. The legislative status quo of the labelling system of genetically modified foods abroad is investigated, and the basic concept, the main body of supervision, the specific legal provisions of the labelling system of genetically modified food in typical countries are combed out, and through the comparison of different systems, The fourth part, in view of the shortcomings of the current labelling system of genetically modified foods in China, focuses on improving the operational rules for the labelling of genetically modified foods. In order to standardize the content, scope and form of GM food labeling, optimize the main body of supervision and improve the relevant supporting systems, the author puts forward legal countermeasures to perfect the labelling system of GMF in China.
