资源型央企环境监管体制研究

【摘要】：对自然资源的高度依赖决定了资源型央企应比其他企业承担更多的生态责任，资源型央企能否履行环境保护的社会责任与企业自身的环保意识有关，同时，外部监管力量也发挥着不可替代的作用。建构有效的资源型央企环境监管体制，是促进企业社会责任履行的关键。本文运用文献研究、定量分析的方法，对资源型央企环境监管体制问题进行研究。资源型央企具有自然性、社会性和政治性，，过分追求经济利益导致企业环境污染状况愈发严重，引起了社会的高度关注。本文从资源型央企环境污染问题以及环境监管现状出发，指出了环境监管存在的困境，深入分析了形成监管困境的深层次原因。并且提出建构以国家环保部门为领导，横向、纵向相结合的环境监管体制，扩大地方的环保权限、完善法律和制度保障、促使央企转变经营方式，进而对地方经济社会发展以及生态环境保护产生积极影响。以完善的法律法规制度为背景，形成国家环保部门牵头的资源型央企环境监管体制，打破了传统环境监管体制的有限性，避免了企业高行政级别的消极影响，满足资源型央企的自身要求和特点，有利于发挥外部监管作用，形成有效的环境监管模式，推动资源型央企绿色生产，保护生态环境。
[Abstract]:The high dependence on natural resources determines that resource-based central enterprises should bear more ecological responsibilities than other enterprises. Whether resource-based central enterprises can fulfill their social responsibility for environmental protection is related to their own awareness of environmental protection, and at the same time, External regulatory forces also play an irreplaceable role. To construct an effective environmental supervision system of resource-based central enterprises is the key to promote the implementation of corporate social responsibility. This paper studies the environmental supervision system of resource-based central enterprises by using the methods of literature research and quantitative analysis. Resource-based central enterprises have natural, social and political nature, excessive pursuit of economic interests, resulting in more serious environmental pollution of enterprises, which has aroused a high degree of social concern. Starting from the problem of environmental pollution in resource-based central enterprises and the present situation of environmental supervision, this paper points out the predicament of environmental supervision, and analyzes the deep-seated reasons for its formation. And put forward to construct the environmental supervision system with the national environmental protection department as the leader, horizontal and vertical combination, expand the local environmental protection authority, perfect the law and system safeguard, urge the central enterprise to change the management mode. Then it has a positive impact on the development of local economy and society and the protection of ecological environment. With the background of perfect laws and regulations, the environmental supervision system of resource-based central enterprises led by the national environmental protection department is formed. It breaks the limitation of the traditional environmental supervision system, avoids the negative influence of the high administrative level of the enterprise, meets the own requirements and characteristics of the resource-based central enterprises, and is conducive to bringing into play the role of external supervision and forming an effective mode of environmental supervision. Promote the green production of resource-based central enterprises and protect the ecological environment.
