警察职务行为中的正当防卫问题研究

【摘要】：因为警察的特殊身份,其在执行职务过程中实施正当防卫行为时,给正当防卫条件的认定带来不少疑难问题。对警察的非法职务行为是否能进行防卫需要具体分析;在是否存在不法侵害的判断标准上,可以借鉴英美法系的主观标准;警察正当防卫的时间条件和普通人并无不同,应当区分正当防卫与职权(职务)行为的界限;警察同样可能实施防卫挑拨、相互斗殴两种不符合主观条件的非法防卫行为;警察在普通防卫中也可以使用武器,在普通防卫中致人死亡也未必都构成防卫过当;警察的特别防卫仍然有防卫过当的成立空间;警察的部分防卫行为需要符合"事先警告"这一限制条件。
[Abstract]:Because of the special identity of the police, it brings a lot of difficult problems to the condition of justifiable defense when it carries out the legitimate defense behavior in the course of carrying out its duties. It is necessary to analyze whether the police's illegal duty behavior can be defended; to draw lessons from the subjective standard of Anglo-American law system in judging whether there is unlawful infringement; the time condition of police's legitimate defense is not different from that of ordinary people. A distinction should be drawn between legitimate defence and functions and powers (duties); the police may also carry out defensive provocations and fight against each other two illegal defence acts which do not meet the subjective conditions; and the police may also use weapons in ordinary defence. The death caused by death in ordinary defense may not always constitute excessive defense; the special defense of the police still has room for the establishment of excessive defense; and part of the defense behavior of the police should meet the restriction of "prior warning".
