我国官员财产申报公示制度研究

【摘要】:经过数十年的改革开放和现代化建设,我国迈入全面深化改革的攻坚期和深水区,调整利益格局,肃清前行障碍,清除体制机制的顽障痼疾,成为实现“两个一百年”宏大目标的必要前提。反腐倡廉是建设党和国家,实现民主政治领域深化改革的重要一环。近几年来,我国的反腐工作持续深入进行,取得了令人瞩目的成就,但当前我国腐败问题依然不容乐观,各类行政职务性犯罪呈高发态势,群众对防止利益冲突、肃清腐败现象、建设廉洁政治有着强烈诉求,严重的腐败隐患倒逼反腐制度改革创新。 官员财产申报公示制度一直被国际上誉为“阳光法案”和“反腐利器”。我国从上世纪80年代末开始探索官员财产申报制度,但由于时机不成熟、制度不健全、官员抵触大等主客观原因,该项制度一度流于形式,没有发挥其预防和惩治腐败的应有效力。2009年开始在我国的个别地区开展了关于官员财产公示的基层试点,但是试点中也出现了一系列问题,不少地区的试点工作都陷入了“人走政息”、“零异议”的尴尬局面;2012年,以广东省、江苏省为代表的新一轮试点工作开始。面对十八大以来反腐斗争高压态势的新形势,社会上对反腐制度化建设的强烈诉求,我们有必要研究如何建立健全我国的官员财产申报公示制度,使之成为我国反腐制度体系中的有力武器。 本文以我国官员财产申报公示制度为研究对象,采用文献分析方法、定性分析法、建构主义方法,将理论探讨与现实观察相结合,国内外制度比较与我国地方试点比较相结合,对官员财产申报公示制度开展制度设计内容的横向观照与制度建设时空条件的纵向分析相结合,从而研究我国建立健全官员财产申报公示制度的可行性和路径方案。具体来说,即通过对官员财产申报公示制度的发展历程、内在要素的梳理,明确制度内涵;通过对我国官员财产申报公示制度的顶层设计、地方试点工作概览,分析该制度在我国运行过程中问题表征和成功经验。针对运行中的问题分析其深层的阻力因素,说明建立健全官员财产申报制度的必要性及有利条件,最后着力分析我国官员财产申报公示制度的构建路径,即在反腐零容忍的制度化反腐、公共利益与个人利益相协调、中国特色与外国经验相融合、德性教育与制度相同步的指导思想下,采用科学规划、由易到难、步小蹄疾的渐进式推进策略,切实推进官员财产申报公示制度的立法进程和制度内涵的健全,完善配套制度和技术支撑,最终凝聚成“立法保障-制度完善-社会支持”的官员财产申报公示制度的完整制度链条,高效发挥官员财产申报公示制度的影响力。
[Abstract]:After decades of reform, opening up and modernization, China has stepped into a period of comprehensive deepening of reform and deep water areas, readjusting the pattern of interests, eliminating obstacles ahead, and clearing up the stubborn and chronic diseases of the system and mechanism. To become a necessary prerequisite for achieving the grand goal of "two hundred years". Combating corruption and advocating honesty is an important link in building the party and country and realizing the deepening of reform in the field of democratic politics. In recent years, the anti-corruption work of our country has continued to go deep and has made remarkable achievements. However, at present, the corruption problem in our country is still not optimistic, and all kinds of administrative job-related crimes are in a high incidence situation, and the masses are concerned about preventing conflicts of interest. In order to eliminate corruption and build clean politics, the serious corruption hidden danger forces the reform and innovation of anti-corruption system. The official property declaration and publicity system has always been praised as "Sunshine Act" and "Anti-Corruption weapon" in the world. Since the end of 1980s, our country began to explore the official property declaration system. However, due to premature timing, imperfect system, officials' resistance to the great and other subjective and objective reasons, this system was once a mere formality. Without giving full play to its due effectiveness in preventing and punishing corruption. In 2009, a grass-roots pilot on the publicity of officials' property began to be carried out in individual regions of our country, but there were also a series of problems in the pilot. In many regions, the pilot work has been plunged into the embarrassing situation of "people walking the policy and interest" and "zero dissent." in 2012, a new round of pilot work, represented by Guangdong Province and Jiangsu Province, began. In the face of the new situation of high pressure in the anti-corruption struggle since the 18th National Congress, and the strong demands of the society for the construction of anti-corruption institutionalization, it is necessary for us to study how to establish and improve the system of declaring and publicizing the property of officials in our country. To make it a powerful weapon in the anti-corruption system of our country, this paper takes the system of declaring and publicizing official property as the research object, adopts the methods of literature analysis, qualitative analysis and constructivism, and combines the theoretical discussion with the practical observation. Combining the comparison of domestic and foreign systems with the comparison of local pilot projects in our country, combining the horizontal view of the contents of the system design of the official property declaration and publicity system with the longitudinal analysis of the space-time conditions of the system construction, Therefore, the feasibility and route scheme of establishing and perfecting the system of official property declaration and publicity in China are studied. Specifically, through the development of the official property declaration and publicity system, the internal elements are combed to clarify the connotation of the system; through the top-level design of the official property declaration and publicity system in China, the local pilot work overview, This paper analyzes the problem representation and successful experience of the system in our country. In view of the problems in operation, this paper analyzes the deep resistance factors, explains the necessity and favorable conditions of establishing and perfecting the official property declaration system, and finally analyzes the construction path of the official property declaration and publicity system in our country. That is, under the guiding ideology of zero tolerance of anti-corruption, coordination of public interest and personal interest, integration of Chinese characteristics and foreign experience, and synchronization of moral education and system, scientific planning is adopted, from easy to difficult. Step by step the gradual advance strategy, promote the legislation process of official property declaration and publicity system and improve the connotation of the system, perfect the supporting system and technical support, Finally, it is condensed into a complete system chain of official property declaration and publicity system of "legislation guarantee, perfect system and social support", which can give full play to the influence of official property declaration and publicity system.
