我国经济适用住房法律制度的问题分析与完善建议

【摘要】:我国住房保障体系中对不同收入家庭实行不同的住房供应政策。其中,对于中低收入家庭可以购买经济适用住房。国家历来重视解决城市居民住房问题,,始终把改善群众居住条件作为城市住房制度改革和房地产业发展的根本目的。但是与住房市场化进程相比,低收入家庭住房保障制度建设相对滞后,经济适用房在一些城市成为“花瓶”和“点缀”,覆盖面与现实需要相比还有相当大的差距。经济适用房在建设和管理中问题不断:开发计划不落实,土地供应难以保证;供应对象模糊,审核不严;有些城市供应规模偏小,造成供不应求现象;建设标准偏大,初期开发建设的房屋面积过大;开发商利润难于控制,某些商品房为规避土地出让金而违规转为经济适用房等。有的城市,经济适用房被开发商变相高价出售,造成经济适用房不“经济”,国家给中低收入购房者提供的福利被开发商占为己有,牟取暴利。由于供应对象的宽泛,经济适用房制度很难保证那些最需要解决住房问题的中低收入家庭的优先权;在个人信用体系和住房档案不健全的情况下,资格审查容易流于形式,出现了骗购、转让获利等现象,使经济适用房制度的公平性受到质疑。 笔者试图通过本文的论述,对我国经济适用住房相关立法中存在的缺陷进行分析,提出自己的观点,希望通过把建立共有产权制度作为完善经济适用住房制度的关键点,并且提出相应对策。 本文第一部分主要是概括经济适用住房的性质、特征、产权属性、存在的意义、历史对的沿革和与其他住房制度的比较分析。主要是想说明经济适用住房制度仍然是我国住房保障制度不可缺少的一部分。 第二部分,主要是对我国经济适用住房法律制度的立法现状和存在的问题进行陈述与分析。先分析我国目前关于经济适用住房制度的立法现状,然后再分析我国立法中存在的问题,接下来再分析我国各省市几种不同的经济适用住房运行模式,从中可以看出共有产权模式的优点及可行性。 第三部分,在上一部分探讨得出共有产权是经济适用住房制度的创新关键点后,对于共有产权制度进行全方位的论述,包括共有产权的含义、特点、法律基础和存在的问题,与此同时还介绍了国外有关共有产权制度相关情况并分析借鉴。 第四部分,想要完善经济适用住房,就要从建立共有产权制度入手,解决经济适用住房产生的问题。先分析共有产权制度中主体间的关系,然后再从立法上对完善经济适用住房制度提出自己的意见。
[Abstract]:The housing security system of our country carries out different housing supply policies for different income families. Among them, for low-middle income families can buy affordable housing. The state has always attached great importance to solving the housing problem of urban residents and has always regarded improving the living conditions of the masses as the fundamental purpose of the reform of urban housing system and the development of real estate industry. However, compared with the process of housing marketization, the construction of housing security system for low-income families lags behind. Comfortable housing has become a "vase" and "embellishment" in some cities, and there is still a considerable gap between the coverage and the actual needs. The problems in construction and management of comfortable housing are as follows: the development plan is not carried out, the land supply is difficult to guarantee, the supply object is vague, the audit is not strict, the supply scale of some cities is too small, the supply is short of supply, and the construction standard is too large. The initial development and construction of the housing area is too large, the profit of developers is difficult to control, some commercial housing to avoid land transfer fees and illegal conversion to comfortable housing and so on. In some cities, comfortable housing is sold at a disguised high price by developers, causing comfortable housing not to be "economic", and the welfare offered by the state to low- and middle-income homebuyers has been taken over by developers for profiteering. Because of the broad supply base, the comfortable housing system is difficult to guarantee the priority of those low- and middle-income families who need to solve the housing problem most; in the absence of a sound personal credit system and housing records, eligibility checks are easily formalized. The fairness of the comfortable housing system has been questioned because of the phenomena of deception and profit transfer. The author tries to analyze the defects in the relevant legislation of affordable housing in China through the discussion of this paper, and put forward his own viewpoint. It is hoped that the establishment of the common property right system will be regarded as the key point of perfecting the economic and applicable housing system, and the corresponding countermeasures will be put forward. The first part of this paper is mainly to summarize the nature, characteristics, property right attribute and the meaning of existence of the economic and applicable housing. History of evolution and comparative analysis with other housing systems. The main purpose is to explain that the economic housing system is still an indispensable part of the housing security system in China. The second part is mainly to state and analyze the legislative status and existing problems of the economic housing legal system in China. This paper first analyzes the current legislative situation of the economic housing system in our country, then analyzes the problems existing in the legislation of our country, and then analyzes several different economic and applicable housing operation modes in various provinces and cities of our country. From this we can see the advantages and feasibility of the common property right mode. The third part, after discussing that the common property right is the innovation key point of the economic and applicable housing system, the third part discusses the common property right system in all directions. Including the meaning, characteristics, legal basis and existing problems of common property right. At the same time, it also introduces the relevant situation of the common property right system abroad and analyzes and uses for reference. The fourth part, want to perfect the economical and applicable housing, Must start from the establishment common property right system, solves the economical suitable housing produces the question. This paper first analyzes the relationship between the subjects in the common property right system, and then puts forward his own opinions on the perfection of the economic and applicable housing system from the legislative point of view.
