经济法视野下的网络食品安全监管研究

【摘要】:随着经济和科技的迅速发展,人们的生活日新月异,网络经济异军突起,与网络相关的事物也被人们喜爱追逐。网络食品便是借助网络技术产生,并因其品种多样、时尚、购买方便及价格优惠等众多优点逐渐融入到社会大众的日常生活。但与普通食品相比,网络食品的法律安全监管情况并不乐观,,网络食品安全纠纷也频繁发生,例如网络食品质量不合格、食品丢失、消费者维权困难等。网络食品经营主体市场准入如何规制;网络食品安全如何有效管理,消费者遭到侵权该如何维护自己的权利等,我国法律都未给予明确规定。法律规定的不详导致现实中食品管理部门遭遇执法不力的尴尬窘境。食品安全责任重于泰山,网络食品亦是食品,网络可以是虚拟的,但食品安全不能虚拟。面对当前网络食品安全监管不力事故频发的现状,为了更好地对网络食品进行监管,保证食品安全,有必要对网络食品安全开展系统的研究。 文章立足网络食品安全监管困境,通过借鉴学者已有的理论成果,从经济法角度分四部分对网络食品的安全管理问题展开研究。 第一部分介绍了网络食品及其市场中的相关要素。包括对网络食品的含义进行界定,明确网络食品具有的特征,介绍网络食品安全监管的理论并对网络食品市场中的主体进行说明,同时还介绍了网络食品的经营模式等。 第二部分介绍了我国当前在网络食品安全监管中存在的法律问题。主要有网络食品监管法律规定不详、效力等级低,网络食品质量安全难以保障,相关部门对网络食品监管难度大,消费者维权困难等。 第三部分介绍了国外对网络食品进行监管的经验,重点介绍了美国、欧盟、韩国等国家通过专门立法、设立专门监管机构对网络食品进行监管,保障食品安全的经验,由此提出了对我国在网络食品安全监管方面的借鉴及启示。。 第四部分重点论述完善我国网络食品安全监管的建议。基于网络食品的特殊性,重点规制网络食品经营者市场准入制度,加强对网络食品市场主体准入的规范及,建立网络食品电子监管平台,明确网络交易平台服务经营者的法律责任,构建权责明确的法制体系,这是实现网络食品安全监管的重要保障。
[Abstract]:With the rapid development of economy and science and technology, people's life is changing with each passing day. Internet food is produced with the help of network technology, and because of its variety, fashion, convenience to purchase and price concessions and many other advantages gradually integrated into the daily life of the public. However, compared with ordinary food, the legal safety supervision of online food is not optimistic, and online food safety disputes also occur frequently, such as the quality of online food is not up to standard, food loss, consumer rights difficulties and so on. The laws of our country have not clearly stipulated how to regulate the market access of online food operators, how to manage network food safety effectively, how to protect the rights of consumers when they are infringed. The lack of legal provisions led to the reality that food management departments encountered an awkward dilemma of weak law enforcement. The responsibility of food safety is more important than Taishan, the network food is also food, the network can be virtual, but food safety can not be virtual. In the face of the current situation that the network food safety supervision is weak and frequent, in order to better supervise the network food and ensure the food safety, it is necessary to carry out systematic research on the network food safety. This paper studies the safety management of online food in four parts from the angle of economic law. The first part introduces the related elements of online food and its market. Including defining the meaning of the network food, defining the characteristics of the network food, introducing the theory of the network food safety supervision and explaining the main body in the network food market. At the same time, it also introduces the management mode of network food. The second part introduces the legal problems existing in the network food safety supervision in our country. There are mainly laws and regulations on online food supervision that are not known, have a low level of effectiveness, are difficult to guarantee the quality and safety of online food, and are difficult for relevant departments to supervise and control online food. The third part introduces the experience of foreign countries in the supervision of online food, focusing on the United States, the European Union, South Korea and other countries through special legislation to set up a special regulatory body to supervise online food. The fourth part focuses on the suggestions of perfecting the supervision of online food safety in our country. Based on the particularity of the network food, this paper focuses on regulating the market access system of the network food operators, strengthening the regulation of the access of the main body of the network food market and establishing the electronic supervision platform of the network food. It is an important guarantee to realize the supervision of network food safety to make clear the legal responsibility of the service operators of the network trading platform and to construct the legal system with clear rights and responsibilities.
