企业标准自我声明制度研究

【摘要】：企业标准自我声明制度是《标准化法》修订的大背景下提出的一项新制度。《标准化法》的修订尊重企业在市场经济中的主体地位,尊重企业在标准化活动中主体地位,企业标准自我声明制度应运而生。企业标准自我声明制度基于标准化的循环上升需要标准信息公开得到反馈,标准信息的不对称需要政府进行规制,单向的政企权威管制到政府、企业、社会合作治理的转变为理论来源,从国外标准管理中的供方符合性声明规范中借鉴经验,具有实施的合理性与可行性。企业标准自我声明制度从企业标准备案制度改革而来,对备案制存在的问题进行了针对性的解决,具有保障消费者知情权、提升企业市场竞争能力、节约政府工作资源和提升产品或服务质量的功能。在《标准化法》中也有制度独自的法律制度构成。然而制度的现实运行既在一定程度上实现了企业标准自我声明制度的制度设计,同时也存在一些制度不足。本文通过对企业标准自我声明制度的运行情况的调研发现制度具有企业执行积极性有待提高、质量安全仍需保障和未形成社会监督的氛围的问题,并从完善正向激励、完善负向激励和衔接配套制度的角度提出了解决制度运行问题的措施,以期制度更好的实施。笔者相信企业标准自我声明制度必将实现国家构建制度的目标,制度的运行也将会引领中国向“标准强国”、“质量强国”、“信用强国”上坚定迈进。
[Abstract]:The enterprise standard self-declaration system is a new system proposed under the background of the revision of the Standardization Law. The revision of the Standardization Law respects the principal position of the enterprise in the market economy and the dominant position of the enterprise in the standardization activities. The enterprise standard self-declaration system arises at the historic moment. The system of enterprise standard self-declaration needs feedback from the public of standard information based on the rising cycle of standardization. The asymmetry of standard information needs government regulation, one-way government and enterprise authority control to the government, enterprises, and enterprises. The transformation of social cooperative governance into a theoretical source, from the foreign standard management in the standard management of the supplier compliance statement of reference experience, with the implementation of the rationality and feasibility. The system of enterprise standard self-declaration comes from the reform of the system of enterprise standard filing. It solves the problems existing in the system of filing and has the ability to protect consumers' right to know and enhance the competitive ability of enterprises in the market. The function of saving government work resources and improving the quality of products or services. In the Standardization Act, there is also a separate legal system. However, the actual operation of the system not only realizes the system design of the enterprise standard self-declaration system to a certain extent, but also has some deficiencies. Based on the investigation of the operation of the enterprise standard self-declaration system, this paper finds that the system has the following problems: the enthusiasm of enterprise execution needs to be improved, the quality and safety still need to be guaranteed and the atmosphere of social supervision is not formed, and the positive incentive is improved. From the angle of perfecting negative incentive and supporting system, this paper puts forward some measures to solve the problem of system operation in order to implement the system better. The author believes that the enterprise standard self-declaration system will realize the goal of national construction system, and the operation of the system will lead China to "standard power", "quality power", "credit power" firmly stride forward.
