试论我国行政程序法典的制定

【摘要】：行政程序法，是指规范行政主体实施行政行为所应遵循的步骤、方式、时限和顺序的法律规范的总称。它对于约束行政主体行使行政权、加强政府依法行政、打造服务型政府、推动国家治理体系和治理能力的现代化有着积极的意义和重要的作用。本文介绍了行政程序法的定义、渊源、功能和价值，，列举了我国现行行政程序立法存在的主要问题，论证了制定统一的行政程序法典的必要性和可行性，设想了我国行政程序法典应规定的内容和架构、应采取的目标模式、应确定的基本原则和基本制度以及违反法定行政程序应承担的法律责任。
[Abstract]:The law of administrative procedure refers to the procedure, mode, time limit and order that should be followed in standardizing the administrative action of the administrative subject. It plays a positive and important role in restricting the administrative subject to exercise the administrative power, strengthening the government administration according to law, creating a service-oriented government, and promoting the modernization of the national governance system and governance ability. This paper introduces the definition, origin, function and value of the administrative procedure law, enumerates the main problems existing in our country's current administrative procedure legislation, and proves the necessity and feasibility of making a unified administrative procedure code. The content and structure, the target mode, the basic principle and system, and the legal responsibility of violating the legal administrative procedure should be envisaged in the administrative procedure code of our country.
