行政法学视野下的中国电影审查模式研究

【摘要】:我国对电影进行监管主要采取行政许可的方式,许可贯穿电影的剧本、制作、内容和发行传播的全部流程。这一制度本质上是公权力对传媒的一种干预,关系到行政主体、行政相对人以及第三人不同主体之间的利益衡量。现行的审查制度本就因存在过多行政干预,阻碍电影自由创作和电影行业的健康发展而饱受垢病;而电影更加开放性的发展趋势更加激化了与我国电影监管制度之间的矛盾,使得电影审查的存与废、电影分级的引入与否等话题成为社会各界关注的热点。目前,我国关于电影审查制度的研究多是框架性、呼吁性的间接研究,对于如何构建适合我国国情的电影审查模式、如何弥补相关法律的空白、建立配套制度方面的问题研究深度不够,提出实质性建议的较少;对于如何实现各主体间的利益平衡、如何保障法律和电影产业的均衡发展等问题上的讨论更是匮乏。基于此,本文试图在解决上述问题的层面做一突破。因此,本文主要从行政法学的视角切入,对电影审查这一交叉性学科问题进行分析。首先,对电影及电影审查的概念进行梳理,系统论证我国现有的电影监管模式存在的问题,特别是对行政相对人和第三人权利的限制问题。其次,在运用比较法对域外分级制存在的合理性和引入的可行性进行分析的基础上,借鉴利益衡量的层次结构理论,从公权力与私权利、制作方与观影人以及不同年龄段观影人之间的权利衡量三个层面,重点考量审查与分级的利弊优劣,这是文章研究的重点,也是核心价值所在。最后,本文尝试定位解决利益冲突的最佳平衡点:电影审查的未来出路应是在许可制度的框架内引入分级制度,理想模式是以受众的年龄为标准将电影分为五级。同时建立相匹配的院线制度,完善配套的监督体系,最终形成一整套完整的符合中国国情的、以审查为基础的特色电影管理制度体系。
[Abstract]:The supervision of film in our country mainly adopts the way of administrative license, which runs through the whole process of film script, production, content and distribution and dissemination. In essence, this system is a kind of interference of public power to the media, which relates to the interests of different subjects of administrative subject, administrative counterpart and third party. The current censorship system is suffering from grime because of excessive administrative interference, which hinders the free creation of films and the healthy development of the film industry, and the development trend of more open films intensifies the contradiction between the film regulatory system and the film regulatory system in China. The existence and abandonment of film censorship and the introduction of film classification have become the focus of attention. At present, the researches on the film censorship system in our country are mostly frame, appeal indirect research, how to construct the film censorship mode suitable for our country's national conditions, how to make up the gap of the relevant laws. The research on the establishment of supporting system is not deep enough, and there are few substantive suggestions. The discussion on how to realize the balance of interests among the subjects and how to ensure the balanced development of the law and the film industry is even less. Based on this, this paper tries to make a breakthrough in solving the above problems. Therefore, from the perspective of administrative law, this paper analyzes the cross-disciplinary issue of film censorship. First of all, the concept of film and film censorship is combed, and the problems existing in the current mode of film supervision in China are systematically demonstrated, especially the restriction of the rights of the administrative counterpart and the third party. Secondly, on the basis of analyzing the rationality of the existence of the extraterritorial classification system and the feasibility of introducing it by using the comparative law, the author draws lessons from the theory of hierarchical structure of interest measurement, from the public power and the private right. There are three levels of rights measurement between producers and filmgoers, as well as between different age groups, which focus on the merits and demerits of review and classification. This is the focus of the article and the core value. Finally, this paper tries to find the best balance for resolving conflicts of interest: the future outlet of film censorship should be to introduce a grading system within the framework of the licensing system, and the ideal model is to divide the film into five levels according to the age of the audience. At the same time, we should set up the matching hospital system, perfect the supporting supervision system, and finally form a complete set of characteristic film management system based on the examination, which is in line with the national conditions of China.
