【摘要】:近年来,我国食品安全事故频发,一系列的食品安全事件导致了社会公众对食品安全问题的强烈关注。如何解决频发的食品安全问题,保障社会公众的生命健康权,成为我国政府亟需解决的问题。2009年,全国人大常委会审议并通过了《中华人民共和国食品安全法》,标志着我国食品安全法律制度的进一步完善。然而,《食品安全法》的通过并未减少食品安全问题的产生。究其原因,一方面是因为法律实施时间短,在执法方面存在着经验的不足,另一方面则是在相关制度方面仍存在着不足。作为解决食品安全问题的重要措施的食品召回制度,在我国《食品安全法》中虽然有明确的规定,使我国食品安全问题的解决有了法律依据,但是就食品召回制度本身而言,其仍有不完善之处。本文理论联系实际,结合西方发达国家成熟完善的食品召回制度和立法实践经验,拟就我国食品召回制度进行剖析,归纳总结其存在的不足之处,并提出自己的完善建议。 全文共分为四章。 第一章首先从介绍食品召回相关概念入手,将其与食品撤除、食品回收等概念作了比较分析。紧接着笔者对学术界存在的有关食品召回制度法律性质认识上的争议提出了自己的观点。通过整理分析,点明食品召回责任的法律属性,总结出食品缺陷的分类和免责事由。最后指出在我国建立食品召回制度的意义,即有利于保护消费者的生命健康权,有利于提升企业的竞争力,有利于适应经济全球化。 第二章对我国食品召回制度的现状进行分析。包括相关立法及配套机制的不足,同时也肯定了我国食品召回制度的特色。 第三章主要运用实证和比较分析的方法,分析和比较美国、加拿大等国家的食品召回制度建立和发展的经验,总结出我国在建立食品召回制度时应向外国借鉴之处。 第四章主要针对我国目前食品召回制度所存在的一系列问题,提出完善食品召回制度的建议和具体措施,即完善食品召回监管机制和启动机制,引入食品召回责任保险制和惩罚性赔偿责任制,建立企业信用制度等。 提出完善我国食品召回制度的具体措施是论文研究的核心部分。前三章都是对第四章内容的铺垫。笔者试图对食品召回制度进行宏观研究,借鉴目前有关食品召回制度的学说和研究成果,结合当前《食品安全法》领域内的最新研究成果,首先确定食品召回制度建立的原则性和方向性问题,然后再具体完善相关配套措施。其中,笔者用经济分析的方法论证了设立惩罚性赔偿制度的原因,并围绕食品召回的启动机制和食品召回责任保险制提出了具体建议。
[Abstract]:In recent years, food safety accidents occur frequently in China, and a series of food safety incidents have caused the public to pay close attention to food safety problems. How to solve the frequent food safety problem and protect the public's right to life and health has become an urgent problem for our government. The standing Committee of the National people's Congress deliberated and adopted the Food Safety Law of the people's Republic of China, which marked the further improvement of the legal system of food safety in China. However, the passage of the Food Safety Act did not reduce food safety problems. On the one hand, there is a shortage of experience in law enforcement because of the short time of law enforcement, and on the other hand, there are still shortcomings in related systems. The food recall system, which is an important measure to solve the food safety problem, has a clear stipulation in the Food Safety Law of our country, which makes the solution of the food safety problem in our country have the legal basis, but as far as the food recall system itself is concerned, There are still some imperfections in it. Combining theory with practice, combined with the mature and perfect food recall system and legislative practice experience in western developed countries, this paper intends to analyze the food recall system in China, sum up its shortcomings, and put forward its own suggestions for perfection. The full text is divided into four chapters. In the first chapter, the concept of food recall is introduced and compared with the concepts of food recall and food recall. Then the author puts forward his own view on the dispute about the legal nature of food recall system. Through sorting out and analyzing, the legal attribute of food recall liability is pointed out, and the classification of food defects and the reasons of exemption are summarized. Finally, it points out the significance of establishing food recall system in China, that is, it is beneficial to protect consumers' life and health, to promote the competitiveness of enterprises, and to adapt to economic globalization. The second chapter analyzes the current situation of food recall system in China. It also affirms the characteristics of food recall system in China. The third chapter analyzes and compares the experience of establishing and developing the food recall system in the United States, Canada and other countries by means of empirical and comparative analysis, and concludes that our country should draw lessons from foreign countries when establishing the food recall system. The fourth chapter mainly aims at a series of problems existing in the current food recall system of our country, and puts forward some suggestions and concrete measures to perfect the food recall system, that is, to perfect the food recall supervision mechanism and the starting mechanism. Introduce food recall liability insurance system and punitive liability system, establish enterprise credit system. It is the core part of the thesis to put forward the concrete measures to perfect the food recall system in our country. The first three chapters are the foreshadowing of the fourth chapter. The author attempts to carry on the macroscopic research to the food recall system, draws lessons from the current theory and the research result about the food recall system, unifies the newest research result in the field of "Food Safety Law", First, the principle and direction of food recall system are determined, and then the relevant measures are improved. Among them, the author uses the economic analysis method to prove the reason of establishing the punitive damages system, and puts forward the concrete suggestion around the food recall starting mechanism and the food recall liability insurance system.
