文化多样性保护与反垄断法文化豁免制度

【摘要】：保护文化多样性的价值追求应当融入反垄断法的制定与实施中,反垄断法应以最为文化友好型的方式来实现其经济效率目标。反垄断法作用于文化市场主要以普通的消费性文化产品为规制对象,对非消费性文化产品应尽量排除反垄断法的适用有些国家立法直接确立图书转售价格维持行为的合法性,或将其作为反垄断法的适用除外,主要是基于文化多样性保护之考虑,但这种法定豁免模式并不符合现代反垄断法的发展趋势,反垄断法对文化多样性的保护应以个案分析为基础,宜采酌定豁免模式。个案分析主要依赖两条豁免路径,一是效率抗辩标准,二是附属限制理论我国《反垄断法》对文化多样性保护虽未有直接规定,但其第15条规定的社会公共利益豁免制度可类推为文化豁免的制度依据,只是需要注意规定的不明确在实践中可能存在适用上的障碍。
[Abstract]:The value pursuit of protecting cultural diversity should be integrated into the formulation and implementation of anti-monopoly law, and the anti-monopoly law should achieve its goal of economic efficiency in the most culturally friendly way. The action of antimonopoly law in cultural market is mainly to regulate the common consumer cultural products. To the non-consumer cultural products, some national legislation should exclude the application of anti-monopoly law directly to establish the legitimacy of book resale price maintenance behavior. Except for the application of anti-monopoly law, which is mainly based on the protection of cultural diversity, but this mode of legal exemption does not conform to the development trend of modern anti-monopoly law. The protection of cultural diversity in anti-monopoly law should be based on case analysis and should adopt a discretionary exemption model. The case analysis mainly relies on two ways of exemption, one is the efficiency defense standard, the other is the subsidiary restriction theory. Although there is no direct regulation on the protection of cultural diversity in our country's Anti-monopoly Law, However, the exemption system of social public interest stipulated in Article 15 can be analogous to the system basis of cultural immunity, but it should be noted that there may be obstacles to its application in practice.
