试析医疗纠纷中第三方调解机制的建立及完善

【摘要】：医疗改革以来尤其是当前一段时期，伴随着公民法律与维权意识的提升，医患矛盾问题日益凸显，，日渐成为一个备受社会关注热点和难点问题。关于医疗纠纷的解决途径，我国传统较多使用的主要是以下三种：诉讼解决、医患自行协商解决、卫生行政部门调解解决。传统的三种途径在医疗纠纷解决中发挥了巨大的作用，但是伴随着社会的发展进步，也暴露出诸多弊端。探索新时期医疗纠纷的合理化解决途径，成为医学界、法律界和公共管理者需要重点考虑的一件事情。 2011年1月1日国家出台了《人民调解法》，为纠纷解决提供了依据，这也为医疗纠纷解决提供了可咨借鉴的思路。社会调解是我国悠久社会传统的重要组成部分，拥有丰厚的文化基础，其高效、便捷、灵活等优点很好的弥补了传统医疗纠纷解决模式的缺点，容易被社会各界所接受，人民调解解决社会纠纷拥有良好的社会基础。依靠人民调解解决医疗纠纷的第三方调解模式具有传统模式无可比拟的优势，我们有必要对医疗纠纷的第三方调解机制做进一步更加深入的研究，完善制度、建立机制，以期更好的解决医疗纠纷问题。
[Abstract]:Since the medical reform, especially in the current period, with the promotion of citizens' awareness of law and rights protection, the contradiction between doctors and patients has become increasingly prominent, which has become a hot and difficult issue of social concern. As to the ways to resolve medical disputes, the traditional methods are mainly as follows: litigation resolution, doctor-patient settlement through consultation, mediation by the health administrative department. The traditional three ways play a great role in the medical dispute resolution, but with the development of the society, it also exposes many disadvantages. To explore the rational solution of medical disputes in the new period and become the medical profession, On January 1, 2011, the state promulgated the people's Mediation Law, which provides the basis for dispute resolution, which also provides a reference for medical dispute resolution. Social mediation is an important part of the long social tradition in our country. It has a rich cultural foundation. It has the advantages of high efficiency, convenience, flexibility and so on. It makes up for the shortcomings of the traditional medical dispute resolution model and is easily accepted by all circles of the society. People's mediation to resolve social disputes has a good social foundation. The third-party mediation model of relying on people's mediation to resolve medical disputes has unparalleled advantages over the traditional model. It is necessary for us to do further in-depth research on the third-party mediation mechanism of medical disputes, improve the system, and establish a mechanism.
