“小产权房”问题及规制对策研究

【摘要】:“小产权房”在近些年来一次又一次的成为社会议论的焦点。由于小产权房不需要缴纳诸如土地出让金、土地征用费、耕地占用税、房产开发税、城市基础设施配套费等费用及成本,因此其销售价格也相对于普通商品房要优惠不少。 然而,由于我国目前的法律政策对小产权房的自由流转作出了种种限制,其身份的“非法”性引发了一系列社会矛盾和纠纷。尽管社会各方面均不断针对小产权房问题表达自己的明确立场,但是面对小产权房背后纷乱繁杂的各种社会政治、经济、法律问题,无论是最为严格的“堵”与较为柔和的“疏”均不能够使得该问题得到妥善处理。 本文引言部分首先分析了“小产权房”的相关基本问题,对笔者的思考路径加以简单的阐述。在正文的四个部分中,第一部分对“小产权房”的定义、特征以及其所处的法律地位的困境进行介绍,为全文的展开论述作下铺垫;第二部分对小产权房法律地位模糊之根源进行探析,指出其根本原因在于集体土地制度的模糊性,同时,对于小产权房背后所牵涉的利益主体的立场做出分析,以明晰各方在小产权房合法化问题上各自的利益考量;第三部分通过对“小产权房”所引发的法律纠纷案例进行分析,指出目前司法实践针对相关问题所作的无奈选择,“失序”的司法判决不利于维护法律的严肃性;最后第四部分,本文站在疏导相关矛盾的角度对小产权房所引发的纠纷提出司法处理建议,当然,更为重要的是,指出我们从根本上解决小产权房问题的制度选择。
[Abstract]:In recent years, "small property right" has become the focus of social discussion again and again. Because the small property house does not need to pay such as land transfer fee, land expropriation fee, cultivated land occupation tax, real estate development tax, urban infrastructure supporting fees and other expenses and costs, so its sales price is more favorable than ordinary commercial housing. However, due to various restrictions on the free circulation of small property houses in China's current legal policies, the "illegal" nature of their status has led to a series of social contradictions and disputes. Although all sectors of society have constantly expressed their clear position on the issue of small property housing, but in the face of various social, political, economic, and legal problems behind small property houses, Neither the strictest plugging nor the softer clogging can properly deal with the problem. The preface of this paper first analyzes the basic problems of "small property right", and gives a brief explanation of the author's thinking path. In the four parts of the text, the first part introduces the definition, characteristics and the dilemma of the legal status of "small property right", which lays the groundwork for the full text. The second part analyzes the root cause of the ambiguity of the legal status of the small property house, and points out that the fundamental reason lies in the fuzziness of the collective land system. At the same time, the position of the interest subject involved in the small property house is analyzed. In order to clarify the interests of each side on the issue of legalization of small property houses, the third part analyzes the cases of legal disputes caused by "small property houses", and points out the helpless choices made by judicial practice in view of the relevant problems at present. The judicial decision of "disorder" is not conducive to maintaining the seriousness of the law. Finally, in the fourth part, this paper puts forward some suggestions on the judicial treatment of disputes caused by the small property right house from the angle of dredging the related contradictions, and, of course, more importantly, Pointed out that we fundamentally solve the problem of small property rights system choice.
