国家监察体制改革的逻辑与取向

【摘要】：中国现行反腐败制度主要由行政监察、纪检监督和检察反腐等三个基本版块构成。这种分治体制有其特定的产生背景和发展历程,并发挥了特定的历史作用。但是,面对新的反腐败压力,多个反腐主体之间在工作中出现的职能分散、衔接不力等弊端日渐凸显。为因应制度反腐的需要,对现行反腐体制予以整合,构建以监察委员会为基本内核的反腐败体制,实属正当其时。制度建设的核心问题在于立法。基于现实条件,国家监察委员会立法可采行"先总后分"模式,即先出台具有基本法属性的《国家监察法》,待条件成熟,再制定《国家监察委员会组织法》和《国家监察程序法》等单行法律。作为一项重大的政治制度改革,国家监察委员会改革将促使国家监察体制由"党政分工"向"党
[Abstract]:China's current anti-corruption system consists of three basic sections: administrative supervision, discipline inspection and procuratorial anti-corruption. This partitioning system has its specific background and development course, and plays a special historical role. However, in the face of new anti-corruption pressure, many anti-corruption subjects appear in the work of the functional dispersion, weak convergence and other shortcomings. In order to meet the need of system anti-corruption, it is timely to integrate the current anti-corruption system and build an anti-corruption system based on the supervisory committee. The core problem of system construction lies in legislation. On the basis of practical conditions, the legislation of the National Supervisory Commission can adopt the pattern of "total first and then divided", that is, the "State Supervision Law", which has the attributes of the basic Law, is issued first, and the conditions are ripe. Furthermore, separate laws such as the Organic Law of the National Supervisory Commission and the Law on State Supervision procedures have been formulated. As a major reform of the political system, the reform of the State Supervision Committee will promote the transformation of the national supervisory system from "the division of labor between the Party and the government" to "the Party".
