我国不可移动文物保护地方性立法比较研究

【摘要】：不可移动文物是人类历史的记载,是人类文明不同阶段的反映,是人类的精神财富。文物是历史的根脉,各地应重视文物的保护。当前,公众对不可移动文物的价值确定了正确的认识观,这种积极的认识一方面产生了正向的作用,另一方面也带来了一些弊端,针对不可移动文物进行破坏的违法行为在各地方接连出现,各地文物保护工作面临严峻的挑战。因此,各地方用立法手段来保护不可移动文物十分必要。法律的引导、规范和保障是不可移动文物保护的重要措施,通过立法对其进行保护是我国法治社会建设的应有之义,也是对传统中华文化的尊重。当前,对不可移动文物的保护主要是通过完善立法来进行保护。本文通过对32个省、自治区、直辖市和港澳特别行政区等地区不可移动文物相关立法资料的收集,发现大部分地方立法已有十年之久,并未随着时代的发展进步而进行完善。当前国内学界对不可移动文物的研究也主要集中在旅游领域、考古领域和技术保护等层面,在法律层面对不可移动文物保护研究的文章著作少之又少。有鉴于此,本文以比较立法的眼光来审视各地方不可移动文物保护的立法现状,对利用比较分析法得出来的结论,分析地方文物保护法规出现的问题并提出自己的建议,以期对山西省不可移动文物保护的立法提供借鉴。全文分为三个部分进行介绍和论述:第一部分:通过阐述不可移动文物保护的内涵、立法原则及立法保护的意义,在对不可移动文物保护立法概述了解的基础上,明确地方不可移动文物保护法规的重要性。第二部分:通过对地方立法资料的整理,阐述我国地方不可移动文物保护的立法概况。在对地方文物保护立法概况了解的基础上,从立法形式和文本内容两方面进行比较分析,总结出地方不可移动文物立法的不足之处以及制度缺陷等问题。第三部分:从三个方面对完善不可移动文物保护立法提出建议。笔者针对第二部分分析的问题,从法规的修改和制度完善两方面对完善地方文物保护法规提出意见,并重点对《山西省实施中华人民共和国文物保护法办法》第二章从修改和增加两方面提出自己的修改建议。
[Abstract]:Immovable cultural relics are the records of human history, the reflection of different stages of human civilization, and the spiritual wealth of human beings. Cultural relics are the root of history and should be protected everywhere. At present, the public has a correct view of the value of immovable cultural relics. There are also some drawbacks. Illegal acts against the destruction of immovable cultural relics have occurred in succession in various places, and the protection of cultural relics in various places is facing severe challenges. Therefore, it is necessary for local governments to protect immovable cultural relics by means of legislation. Legislative protection of immovable cultural relics is due to the construction of a society ruled by law and respect for traditional Chinese culture. At present, the protection of immovable cultural relics is mainly carried out by improving legislation. Collection, found that most of the local legislation has been ten years, not with the development and progress of the times to improve. Currently, the domestic academic research on movable cultural relics are mainly concentrated in tourism, Archaeology and technical protection, in the legal level of the protection of movable cultural relics research articles are rare. In view of this, this paper examines the legislative status of the protection of immovable cultural relics in different localities from the perspective of comparative legislation, analyzes the problems of local laws and regulations on the protection of cultural relics and puts forward some suggestions to provide reference for the legislation on the protection of immovable cultural relics in Shanxi Province. The first part is to clarify the importance of local laws and regulations on the protection of immovable cultural relics on the basis of an overview of the legislation on the protection of immovable cultural relics. The second part is to clarify the importance of local laws and regulations on the protection of immovable cultural relics through the collation of local legislative information. On the basis of understanding the general situation of local cultural relics protection legislation, this paper makes a comparative analysis of the legislative form and text content, and summarizes the deficiencies and institutional defects of local non-movable cultural relics legislation. Part III: Perfect the protection of non-movable cultural relics from three aspects. In view of the problems in the second part, the author puts forward some suggestions on how to improve the local laws and regulations on cultural relics protection from the aspects of law amendment and system perfection, and puts forward his own suggestions on how to amend and increase the second chapter of the Measures for Implementing the Law of the People's Republic of China on the Protection of Cultural Relics in Shanxi Province.
