我国老年人保健品安全监管法律问题与对策

【摘要】：随着现在社会的不断发展,也随着我国渐渐步入老龄化社会,老年人不同程度的都患有一些慢性疾病,而且由于儿女工作忙碌时常不能陪伴在老人身边,使得老年人在生活中越发的感到孤独。“花钱买健康”的保健品宣传广告开始得到老年人的认同,使得老年人保健品市场迅速的发展起来。但是我国的保健品市场由于政府监管不力、企业自律性差、缺乏相应的法律法规规制,使得我国的保健品市场乱象丛生。虚假广告遍地开花、产品质量良莠不齐、相似产品种类泛滥成为这个行业的突出问题。为了百姓的生命健康,同时也为了提高我国保健品市场的综合竞争力,加强我国保健品安全监管已迫在眉睫。针对这样的严峻问题,本文主要通过三个部分进行相应的论述。第一部分主要论述我国老年人保健品安全监管的界定及市场的问题。由于老年人是我国保健品市场的主要消费人群,所以本文仅以老年人保健品市场为切入点来分析我国现在的保健品市场问题。通过归纳保健品市场的问题,进而提出安全监管的必要性。第二部分主要论述我国老年人保健品安全监管中所存在的法律问题。主要从法律法规、监管机制、责任追究机制三个方面进行分析。政府作为保健品安全监管中的主要主体,由于监管缺乏相应的法律依据、行政监管机制的不合理、行政责任追究不到位等原因使得监管不力、监管不作为的现象时有发生。第三部分主要论述对完善我国保健品安全监管的一些法律对策。主要提出需要完善保健品安全监管相应的法律制度、创新监管机制、完善相关的责任追究制度与诉讼制度和加大法制宣传。利用政府与社会的双重力量来更好的规制不法行为,提高政府的监管力度,提升消费者的购买信心。
[Abstract]:With the continuous development of the present society and the aging society of our country, the elderly suffer from some chronic diseases to varying degrees, and their children are often unable to accompany them because of their busy work. Make old people feel more lonely in life. The advertisement of "pay for health" began to get the recognition of the elderly, which made the market of health products for the elderly develop rapidly. However, the health products market in our country is chaotic because of the weak supervision of the government, the poor self-discipline of enterprises and the lack of corresponding laws and regulations. False advertising everywhere, product quality intermingled, similar kinds of products become a prominent problem in this industry. It is urgent to strengthen the safety supervision of health products in order to improve the comprehensive competitiveness of the health care products market. In view of this serious problem, this article mainly through three parts to carry on the corresponding discussion. The first part mainly discusses the definition of safety supervision and market of health products for the elderly in China. Since the elderly are the main consumers in the health products market of our country, this paper only analyzes the problems of the health products market in our country from the point of view of the market of the health products for the elderly. The necessity of safety supervision is put forward by summarizing the problems of health products market. The second part mainly discusses the legal problems existing in the safety supervision of health products for the elderly in China. Mainly from the laws and regulations, supervision mechanism, accountability mechanism three aspects of analysis. The government as the main body of health product safety supervision, because of the lack of corresponding legal basis of supervision, the unreasonable administrative supervision mechanism, the lack of administrative responsibility investigation and other reasons, such as ineffective supervision, the phenomenon of regulatory inaction has occurred from time to time. The third part mainly discusses some legal countermeasures to improve the safety supervision of health products in China. It mainly puts forward the need to perfect the corresponding legal system of health product safety supervision, to innovate the supervision mechanism, to perfect the related accountability investigation system and litigation system and to increase the legal publicity. Using the dual power of government and society to better regulate illegal behavior, improve government supervision, enhance consumer confidence.
