涉危险废物环境行政处罚案例研究及建议

【摘要】:通过分析748件涉及危险废物的环境行政处罚案例,研究了中国与危险废物相关的违反环境行政处罚案例的特征,为涉及危险废物的行业自律及政府监管提供参考。结果表明,经济发达地区的案例数量远多于欠发达地区,涉及最多的危险废物种类为HW49其他废物,从危险废物的产生到利用和处置全过程都有相关案例发生,化学原料和化学制品制造业是案例高发行业,当前多以0~2万元的小额罚款为主。在案例特征分析的基础上,提出了相关建议。
[Abstract]:By analyzing 748 cases of environmental administrative punishment related to hazardous wastes, this paper studies the characteristics of environmental administrative penalties related to hazardous wastes in China, and provides a reference for self-discipline and government supervision of hazardous wastes. The results show that the number of cases in the economically developed areas is much more than that in the less developed areas, and the most hazardous wastes involved are other wastes of HW49, which are related to the whole process from the generation of hazardous wastes to the use and disposal of hazardous wastes. Chemical raw materials and chemical products manufacturing is a case-high-incidence industry, most of the current small fines of 0-20, 000 yuan. Based on the analysis of case characteristics, some suggestions are put forward.
