房屋登记相关法律问题研究

【摘要】:房屋登记,是指房屋登记机关依法将房屋权利和其他应当记载的事项在房屋登记簿上予以记载的行为。对房屋登记性质的探讨是一个理论层面的话题,却同时具有指引时间的现实意义。房屋登记在对现在社会发展有着重要的影响,不可忽视它的作用及其价值。随着十八届三中全会的召开,制定统一的不动产登记制度和征收房产税是势在必行。笔者认为解决房屋登记的问题是一个长久的历史问题。我国现行《房屋登记办法》存在着诸多问题,因房屋登记中城乡管理不统一,存在着差异,所以针对该问题应建立统一的城乡房屋登记规则;现有的房屋登记的方式还不够完善,应完善房屋的登记方式,更大程度上保护权利人的合法权利;各登记规范之间存在着较大的冲突,不能有效规制房屋登记制度;房屋登记规范的适用范围过窄,一些地方不适用现行的规范制度。针对这些问题笔者提出了一些解决对策。修订相关法律法规来解决各制度规范之间的冲突;建立城乡统一的房屋登记规则;统一房屋登记机关;完善缺乏的房屋登记方式。立法要遵守十八大会议的精神,尽快出台解决相关问题的立法,笔者认为解决这些问题只是时间的问题。
[Abstract]:Housing registration refers to the act that the housing registration authority records housing rights and other items that should be recorded in the housing register according to law. The discussion of the nature of housing registration is a theoretical topic, but it has the realistic significance of guiding time at the same time. Housing registration plays an important role in the development of society, and its function and value can not be ignored. With the holding of the third Plenary session of the 18th CPC Central Committee, it is imperative to establish a unified real estate registration system and levy real estate tax. The author thinks that solving the problem of housing registration is a long-term historical problem. There are many problems in the present housing registration method in our country. Because the management of urban and rural areas is not unified and there are differences in housing registration, we should establish unified rules of housing registration in urban and rural areas in view of this problem. The existing ways of housing registration are not perfect, so we should perfect the way of housing registration and protect the legal rights of the right holders to a greater extent, and there is a great conflict between the registration norms, which can not effectively regulate the housing registration system. The scope of application of housing registration code is too narrow, some places do not apply the current normative system. In view of these problems, the author puts forward some countermeasures. To amend the relevant laws and regulations to resolve the conflict between the system and norms; to establish a unified housing registration rules between urban and rural areas; to unify housing registration authorities; to improve the lack of housing registration methods. Legislation should abide by the spirit of the 18th National Congress of the Congress, as soon as possible to solve the relevant issues of legislation, the author thinks that to solve these problems is only a matter of time.
