互联网平台提供商的民事侵权责任分析

【摘要】：互联网平台提供商的民事侵权责任边界关乎"互联网+"经济的健康发展。互联网平台提供商侵权责任承担有主动介入与被动应对两种不同的应对模式。互联网平台提供商的民事侵权责任承担必须符合技术与商业发展现实,不能要求其承担一般的普遍监控民事侵权行为的义务,但其应承担一定的管理平台以及与权利人合作的义务。互联网平台提供商违反管理与合作的注意义务并不必然承担民事侵权责任。互联网平台提供商必须对具体的民事侵权行为存在过错才应承担侵权责任。
[Abstract]:The tort liability boundary of Internet platform providers is related to the healthy development of the "Internet +" economy. The Internet platform providers assume two different coping modes: the initiative and the passive response. The tort liability undertaking of Internet platform providers must conform to the reality of technology and business development, and can not be demanded. The Internet Platform Provider does not necessarily bear civil tort liability for breach of the duty of care in management and cooperation. The Internet Platform Provider must be at fault for specific civil torts. Tort liability shall be borne.
