基于“三权分置”的农村土地经营权二元法律制度构造

【摘要】:我国现行“集体所有,农户承包”的“两权分离”农村土地制度,尽显其无法满足城镇化需求的土地流转僵化性。土地所有权、承包权、经营权“三权分置”的构想,缺乏相应的经营权法律制度配套,阻碍了现实中土地的有效流转。“三权分置”的农村土地权利法律制度构建,重心在于农村土地经营权的法律逻辑结构与现实国情,将土地经营权从承包权中独立出来,构造物权化和债权化并置的二元农村土地经营权制度。法律上明确,经过登记公示的为物权性土地经营权,未登记公示的为债权性土地经营权。
[Abstract]:The current rural land system of "collective ownership and peasant household contracting" shows the rigidity of land circulation which can not meet the needs of urbanization. The conception of land ownership, contract right and management right of "three rights separated" is lack of corresponding legal system of management right, which hinders the effective circulation of land in reality. The construction of the rural land rights legal system of "three rights divided" focuses on the legal logic structure of the rural land management right and the reality of the national conditions, which makes the land management right independent from the contract right. Construct dual system of land management right of rural land which is juxtaposed with real right and creditor's right. It is clear in law that the registered land management right is real right, and the unregistered land management right is creditor's right.
