新技术革命与中国科技法制建设

【摘要】：科技引领生活，新科技革命的浪潮席卷全球每一处角落；科技重构世界，现代科技发展水平和层次的高低，直接决定一个国家在国际舞台上的地位和分量，正如邓小平同志精辟阐述的那样：科学技术不仅是生产力，而且是第一生产力。在新科技革命大环境大背景之下，从国家发展、社会进步到公民个人生活都发生了重大变化，社会结构、社会阶层也随之发生质的变动，新科技革命催生的各种新生事物，使得社会生活更加复杂和多变。作为“物质基础”的“客观世界”变化必然会促使作为“上层建筑”的“法律制度”做出相应的调整和改变。法律只有以其灵活性和适应性呈现，才能满足处于不断变化中的、纷繁复杂的社会的需要。科技法制建设的兴起和发展，是科技发展的需求和结果，也是法律不断自我完善的内在表现。科技的日新月异不断的给法律提出新的问题和挑战，，如何有效减轻法律的滞后性给科技发展带来的不良影响？如何建立健全更科学合理的法律体系、法律制度为科技发展披荆斩棘、保驾护航？现代科技的璀璨成果又如何为法律自身的突破和成熟发挥作用？这些都是非常值得深入研究和探讨的重大课题。
