国外校园欺凌立法治理体系:现状、特点与借鉴——基于七个发达国家的比较分析

【摘要】:美国、英国、澳大利亚、瑞典、挪威、日本和韩国等发达国家在校园欺凌国家立法、地方立法、政策措施、项目实施等方面积累了成功经验。七个发达国家校园欺凌治理体系的特点主要体现在:法制体系完善;适应形势变化,不断修改旧法,颁布新法;重视校园欺凌问题的调查和研究,为完善制度体系提供决策信息;强化各方职责,注重过程监控,对校园欺凌"零容忍";搭建各种防治校园欺凌平台,治理校园欺凌"不留死角"和注重对网络欺凌的治理。我国校园欺凌治理的制度建设还存在诸多不足,这七个发达国家的立法治理体系可为我国处理校园欺凌提供重要参考。
[Abstract]:Developed countries such as the United States, Britain, Australia, Sweden, Norway, Japan and South Korea have accumulated successful experience in school bullying national legislation, local legislation, policy measures, project implementation and so on. The characteristics of campus bullying governance system in seven developed countries are as follows: perfect legal system, adapt to the changing situation, constantly revise old laws and promulgate new laws; Pay attention to the investigation and research of campus bullying, provide decision-making information for perfecting the system, strengthen the responsibilities of all parties, pay attention to process monitoring, and "zero tolerance" to campus bullying; Build various prevention and cure campus bullying platform, control campus bullying "do not leave the corner" and focus on the governance of cyberbullying. There are still many deficiencies in the system construction of campus bullying governance in China. The legislative governance system of these seven developed countries can provide an important reference for our country to deal with campus bullying.
