行政法视野下大气污染防治的地方治理研究

【摘要】：大气环境的污染问题与人们的生活息息相关,大气环境的污染对人民的健康安全造成了很大地威胁。大气环境作为一种特殊的环境资源,其本身具有较强的特殊性,由于市场主体和个人在获得和使用大气环境时无需付出对价,所以并不会积极主动追求对大气环境的保护。因而,考虑到社会发展的需要,政府干预成为了必然的选择。必须由政府出面组织、协调大气污染的防治工作,这样才能切实解决环保问题,维护公众利益。透过行政法学视野对地方大气污染的治理问题进行研究,涉及到地方治理中的地方立法、行政理念、行政职能和行政执法等多个维度,本文试图通过在行政法学的视角下对地方治理大气污染防治的工作进行研究,为我国地方进行大气污染的治理工作提供有效的对策。文章主要体系如下：第一章探究我国在大气污染防治工作中的地方治理问题,通过梳理治理大气污染工作中地方历史发展脉络及背景,并通过三个典型地方治理经验,总结现阶段我国地方政府在大气污染中的治理状况。第二章以美国为例,通过总结归纳,探究美国不同的州在大气污染治理中所呈现出的特色。第三章作为本文的重点,通过比较分析法从地方治理中的地方立法、行政理念、行政职能和行政执法等多个维度对中外地方在治理大气污染过程中的特色进行了对比,并分类梳理出我国地方在大气污染治理工作中所存在的缺失。第四章从提出合理对策的角度出发,就加强地方立法、转变行政理念、优化政府职能、强化行政执法等四个方面,探索和完善我国地方治理大气污染工作的对策。以期望有助于我国各地方在大气环境污染的治理过程中,充分发挥治理效能。
[Abstract]:The pollution of atmospheric environment is closely related to people's life, and the pollution of atmospheric environment poses a great threat to people's health and safety. As a special environmental resource, the atmospheric environment has its own strong particularity. Because the main body of the market and individuals do not have to pay the price when they acquire and use the atmospheric environment, they do not actively pursue the protection of the atmospheric environment. Therefore, considering the needs of social development, government intervention has become an inevitable choice. The government must organize and coordinate the prevention and control of air pollution so as to effectively solve the environmental problems and safeguard the public interests. From the perspective of administrative law, this paper studies the control of local air pollution, which involves the local legislation, administrative concept, administrative functions and administrative law enforcement in local governance. This paper attempts to study the prevention and control of local air pollution from the perspective of administrative law, and to provide effective countermeasures for the local control of air pollution in China. The main system of this paper is as follows: the first chapter explores the local governance problems in air pollution prevention and control in China, through combing the local historical development context and background in the air pollution control work, and through three typical local governance experience. Summary of the current situation of local governments in the air pollution control. The second chapter takes the United States as an example to explore the characteristics of different states in the treatment of air pollution by summing up and summing up. The third chapter as the focus of this paper, through the comparative analysis of local legislation, administrative concepts, administrative functions and administrative law enforcement and other aspects of local governance in the process of air pollution control in China and foreign characteristics are compared. And sort out the absence of local air pollution control work in China. From the point of view of putting forward reasonable countermeasures, the fourth chapter explores and consummates the countermeasures of local control of air pollution in our country from four aspects: strengthening local legislation, changing administrative idea, optimizing government function and strengthening administrative law enforcement. It is expected that it will be helpful to bring into full play the control efficiency in the process of air pollution control in all parts of our country.
