违法成本评估研究

【摘要】：违法成本评估是合理制裁违法行为人违法行为的重要环节之一,然而,目前我国行政法制度中这一环节还处于缺失状态,以致行政执法实践中一些行政制裁行为并没有达到预期的矫正违法行为的目的。十八届四中全会《决定》要求行政法治体系要更加严密,行政执法更加注意技术细节,行政制裁更要强调过罚相当。这为违法成本评估制度的建立确立了法治大背景。为此,我们认为,从整体上构建违法成本评估制度是非常必要的。具体而言,应将违法成本评估作为行政程序的构成部分、将违法成本评估作为行政执法的环节、将违法成本评估作为行政制裁的辅助手段、将违法成本评估作为行政责任的内容。
[Abstract]:The assessment of illegal cost is one of the important links to punish the illegal behavior reasonably, however, this link is still missing in the administrative law system of our country at present. As a result, some administrative sanctions in the practice of administrative law enforcement did not achieve the purpose of rectifying the illegal acts. The decision of the fourth Plenary session of the 18th CPC Central Committee requires that the administrative rule of law system be more stringent, the administrative law enforcement pay more attention to the technical details, and the administrative sanctions emphasize that the punishment is equal. This established the background of rule of law for the establishment of illegal cost evaluation system. To this end, we believe that the overall construction of illegal cost assessment system is very necessary. Specifically, the assessment of illegal cost should be regarded as an integral part of administrative procedure, an assessment of illegal cost as a link of administrative law enforcement, and an auxiliary means of administrative sanctions. The cost of illegal assessment as the content of administrative responsibility.
