我国职业教育校企合作现状与法律法规研究

【摘要】:职业教育是国民教育体系重要组成部分,作为职业教育人才培养模式,校企合作对于培养高素质技术技能人才具有不可替代的作用。党和政府制定一系列政策文件鼓励校企合作,职业院校也纷纷与企业开展合作,联合培养人才。然而,我国目前职业教育校企合作普遍存在合作模式单一、合作层次浅、企业缺乏积极性、政府职责不清、参与主体权利与义务不明确、实习学生维权困难等问题,这些制约校企合作的开展,限制职业教育人才培养能力的提升。 本文采用实地调研、文献分析、对比分析等研究方法,分析校企合作法律法规,力求从法律制度层面破解校企合作难题。首先,运用调查研究方法,通过访问校企合作相关主体,厘清校企合作面临的主要问题和困难,在此基础上,梳理并分析我国中央与地方校企合作法律法规,探究法律制度缺失对校企合作的影响。其次,考察德国、美国、日本等职业教育发达国家校企合作立法,总结经验与启示。最后,在分析国内法律法规并借鉴国外先进经验的基础上,提出通过修订《职业教育法》,增加有关校企合作的内容,适时出台全国性校企合作专门法规,加快地方校企合作立法等途径,有步骤地完善职业教育校企合作法律法规体系。
[Abstract]:Vocational education is an important part of the national education system. As a mode of training vocational education talents, the cooperation between school and enterprise plays an irreplaceable role in cultivating high-quality technical talents. The Party and government have formulated a series of policy documents to encourage cooperation between schools and enterprises, and vocational colleges and universities have also cooperated with enterprises to jointly train talents. However, at present, there are some problems such as single cooperation mode, shallow cooperation level, lack of enthusiasm of enterprises, unclear responsibilities of government, unclear rights and obligations of participating subjects, difficulties in safeguarding rights of intern students, and so on. These restrict the development of cooperation between schools and enterprises, and limit the promotion of vocational education talents training ability. In this paper, field investigation, literature analysis, comparative analysis and other research methods are used to analyze the laws and regulations of the cooperation between schools and enterprises, in order to solve the problems of cooperation between schools and enterprises from the legal system level. First of all, by using the method of investigation and research, the main problems and difficulties faced by the cooperation between schools and enterprises are clarified by visiting relevant subjects of cooperation between schools and enterprises, and on this basis, the laws and regulations of cooperation between central and local schools and enterprises are sorted out and analyzed. Explore the lack of legal system on the impact of cooperation between schools and enterprises. Secondly, it investigates the legislation of school-enterprise cooperation in vocational education developed countries, such as Germany, America and Japan, and sums up its experience and enlightenment. Finally, on the basis of analyzing domestic laws and regulations and drawing lessons from the advanced experience of foreign countries, it is proposed that, by amending the Vocational Education Law, the contents of the cooperation between schools and enterprises should be increased, and special regulations on cooperation between schools and enterprises should be issued in due course. Speed up the local school-enterprise cooperation legislation and other ways to improve the vocational education school-enterprise cooperation laws and regulations.
