针对我国公务员聘任制法律完善层面的探讨

【摘要】:《公务员法》第十六章"职位聘任"确立了我国公务员聘任制的法律地位。试点实践中存在的诸多问题,充分反映了现行《公务员法》对公务员聘任制的规定还存在定位不明、适用范围不清、考核规制不严等法律问题。本文结合试点实践,紧扣法律问题,对公务员聘任制的定位、适用范围、考核等提出了完善措施,以期公务员聘任制在现行法律框架下,实现更好的发展。
[Abstract]:Chapter 16 of the Civil servant Law, "position appointment", establishes the legal status of civil servant appointment system in China. There are many problems in the practice of the pilot project, which fully reflect the legal problems such as unclear orientation, unclear scope of application and lax examination and regulation of the current Civil servant Law. Based on the practice of the pilot project, this paper puts forward some perfect measures for the orientation, application scope and examination of the appointment system of civil servants in order to achieve a better development of the system under the current legal framework.
