企业食品安全社会责任法律问题研究
[Abstract]:As the ancient saying goes, "the people take food as the sky". Since ancient times, the problem of food safety has not only been closely related to the health of the people, but also directly affected the harmony and stability of the society and the healthy development of the nation. In recent years, Jiyuan Shuanghui added "lean meat essence" pork, Shanghai Shenglu enterprise made "dyed steamed bread", Tianjin and other places processed "gutter oil". The appalling accidents related to food safety such as "pig bone soup essence" are frequently used in Weiqian (China) holding limited enterprises. The government and other authorities attach great importance to them, and scholars from all walks of life have made a thorough study on them. Food production enterprises are the main body to ensure food safety and shoulder social responsibility. This paper adopts literature reference method, normative analysis method, empirical analysis method and comparative analysis method. Taking the social responsibility of the relevant food production enterprises as the foundation stone, this paper actively seeks the effective way for the food production enterprises to fully implement the social responsibility for food safety in order to ensure food safety and protect the legitimate rights and interests of consumers. The core of this paper is the following three parts: the first part, this part analyzes the concept of corporate food safety social responsibility, and defines the study of food production enterprises as the object, The characteristics of its social responsibility include: to ensure food safety as the key safety, the enterprise is the primary responsibility party to bear the social responsibility for food safety, and the connotation and denotation is variable. It is obvious that it is necessary for enterprises to undertake social responsibility for food safety, including: to protect the legitimate rights and interests of consumers, to improve the competitiveness of food production enterprises, to maintain social order and stability, to promote the construction and improvement of food safety system. The second part discusses the current situation of food production enterprises to implement food safety social responsibility, analyzes the current implementation of corporate food safety social responsibility in China facing the plight, including the inefficient implementation of the HACCP system within the enterprise. Food industry self-discipline mechanism is not perfect, corporate social responsibility information disclosure report is not comprehensive, enterprise food safety credit file system is not perfect. The third part discusses how to perfect the social responsibility of food safety in Chinese enterprises. First of all, from the perspective of perfecting the implementation mechanism of food safety social responsibility in enterprises, perfecting the application of HACCP system in enterprises, secondly, strengthening the self-discipline ability of food industry; Thirdly, strengthen the corporate social responsibility information disclosure report through external audit; finally, refine the food safety credit file system to make it more complete.
