义务教育学生申诉制度研究

【摘要】:义务教育在整个教育过程占有重要的地位,是其它教育的基础,对于塑造人格,养成良好的习惯有着举足轻重的作用。文章首先对义务教育学生申诉制度进行概括。从义务教育学生申诉制度的概念、确立制度的必要性和义务教育学生申诉制度的特点三方面着手分析。学生申诉权是宪法和法律赋予义务教育学生的一项救济权利的权利,把这一法律规定的权利具体化需要各个学校和教育行政部门建立和完善学生申诉制度。义务教育学生申诉制度是学生申诉权的制度保障,是学生申诉权利在教育行政法律关系中的具体体现。是指处于义务教育阶段的学生,当其权利受到来自学校、教师行为的侵犯时,向学校、教育行政部门的专门机构提出申诉的制度,具体包括校内申诉和向教育行政部门申诉。义务教育学生申诉制度有着区别于普通学生申诉制度的特点。建立义务教育学生申诉制度有着现实的紧迫性和必要性,我们应该给予足够的重视。 文章的第二部分对我国义务教育学生申诉制度的现状做了介绍。我国义务教育学生申诉制度的现状令人担忧。立法中没有义务教育学生申诉制度的专门规定,把义务教育学生申诉制度和非义务教育学生的申诉制度混为一谈。大多学校和教育行政部门没有独立、规范的申诉机构。即使有申诉机构,机构组成人员也不合理、不科学。学生的申诉范围不明确,或者过于笼统缺乏可操作性,或者不符合义务教育特点。申诉过程缺乏具体的程序权利和程序制度。作为申诉制度核心内容,这一点直接影响到申诉处理结果的合理性和可接受性。受长期传统思想的影响,学生和家长的法律意识淡薄,对权利的认识相对不足,不利于学生申诉制度的推进。总之,目前,我国的义务教育学生申诉制度从理论到实践都存在较多问题。 文章的最后一部分主要针对以上问题,提出了应对措施和具体方案。需要我们进行专门的义务教育申诉制度的立法,不仅仅依赖于参照高校的立法规范。另外,要规范申诉机构的组成人员,降低行政人员比例,加入法律、教育学和心理学等方面的专业人士,增加一定数量的学生和家长代表,确保申诉机构的相对中立性特点。进一步明确和细化申诉范围。《教育法》中关于申诉范围的规定过于笼统,应当根据义务教育阶段的特点制定细致且宽泛的申诉范围。将申诉过程细化为具体可操作的程序,并确立一系列的制度,诸如合议制度、回避制度、听证制度等。逐步强化学生和家长的法律意识,发挥家长的监督和管理作用。
[Abstract]:Compulsory education plays an important role in the whole process of education. It is the basis of other education and plays an important role in shaping personality and developing good habits. At first, the article generalizes the appeal system of compulsory education students. This paper analyzes the concept of compulsory education student appeal system, the necessity of establishing system and the characteristics of compulsory education student appeal system. Student's right of complaint is a right of relief granted by constitution and law to compulsory education students. It is necessary for every school and educational administrative department to set up and perfect the system of student complaint to concretize the right stipulated by this law. The appeal system of compulsory education students is the system guarantee of students' right of appeal, and it is the concrete embodiment of students' right of appeal in the legal relationship of education administration. Refers to the compulsory education stage of the students, when their rights from the school, teachers behavior violations, to the school, education administrative department of the special institutions of the appeal system, including the school appeal and appeal to the education administration department. The appeal system of compulsory education students is different from that of ordinary students. It is urgent and necessary to set up compulsory education student appeal system, so we should pay enough attention to it. The second part of the article introduces the current situation of compulsory education student complaint system in China. The present situation of compulsory education student appeal system in our country is worrying. There is no special stipulation on the appeal system of compulsory education students in the legislation, and the appeal system of compulsory education students is confused with that of non-compulsory education students. Most schools and educational administrations do not have an independent, standardized complaints body. Even if there is a complaints body, the composition of the organization is unreasonable and unscientific. The student's appeal scope is not clear, or too general lack of maneuverability, or does not accord with the compulsory education characteristic. The complaint process lacks specific procedural rights and procedural systems. As the core content of the appeal system, this directly affects the rationality and acceptability of the result of handling the complaint. Under the influence of long-term traditional thought, students and parents have weak legal consciousness and lack of understanding of rights, which is not conducive to the promotion of student appeal system. In a word, at present, there are many problems in compulsory education student appeal system in our country from theory to practice. The last part of the article mainly aims at the above question, has proposed the countermeasure and the concrete plan. We need special compulsory education appeal system legislation, not only rely on the legislative norms of colleges and universities. In addition, it is necessary to standardize the composition of the complaint organization, reduce the proportion of administrative personnel, join professionals in the fields of law, education and psychology, increase a certain number of students and parents' representatives, and ensure the relatively neutral characteristics of the complaint institution. The provisions on the scope of appeal in the Education Law are too general and should be formulated according to the characteristics of compulsory education. The appeal process is refined into concrete and operable procedures, and a series of systems are established, such as collegial system, challenge system, hearing system and so on. Gradually strengthen the legal awareness of students and parents, and give play to the role of parental supervision and management.
