论我国高校信息公开制度

【摘要】:随着我国市场经济的发展和法治社会的建设,我国公民法律意识在逐步提高,社会公众参与公共事务的积极性也在不断增加。并且随着信息化时代的到来,公众对信息的需求显著增加,获取的途径也显著增多。因而,知情权的概念开始进入舆论,并日益深入人心,社会公众对于信息,尤其是公共信息的透明度要求使得信息公开制度应运而生。我国于2008年5月颁布《政府信息公开条例》,要求行政机关实行信息公开制度。而高等学校基于其公共性,并且作为教育领域的公共企事业单位也应当承担信息公开义务,教育部于2010年4月颁布的《高校信息公开实施办法》对此做出规定。但高校信息公开作为一个新生事物,在实践中不免遇到困难与挑战,这引起了学者们的关注和讨论。本文通过文献研究和实证调查,从我国高校信息公开的基本概念和基本理论出发,揭示我国高校信息公开的现状和问题,并提出相应的改善建议和期望。除了引言和结语外,,本文共分为四个部分: 第一章我国高校信息公开的基本概念及历史沿革。本章通过概念分析,阐述高等学校的界定、高校信息的内涵以及高校信息公开的特殊性;并对我国高校信息公开的历史沿革进行梳理,总结高校信息公开与校务公开的区别,以表明我国已经正式实施高校信息公开制度。 第二章我国高校信息公开的基本理论。我国已经将高等学校作为信息公开的义务主体,因此有必要对我国高校信息公开的基本理论进行梳理,从根本上理解高校信息公开制度。本章从分析高等学校的法律地位出发,阐述我国高校在信息公开领域的法律地位,并揭示我国高校信息公开的理论基础——高等学校的公共性和社会公众的知情权。 第三章我国高校信息公开的现状及存在问题。我国高校信息公开制度建设仍在进行,取得了一些成绩,但是存在的问题还是不少的,比如高校信息公开的意识薄弱、《办法》在立法上的不足以及高校办学自主权与高校信息公开难以平衡等。这些问题的存在使得高校信息公开工作远远不能满足社会公众的期盼。 第四章我国高校信息公开的完善。针对第三章提出的问题,本章提出通过内部建设和外部支持,平衡信息公开和办学自主权、推动强化重点信息的公开、完善《办法》相关制度等有效措施,建设和完善我国高校信息公开制度。
[Abstract]:With the development of China's market economy and the construction of a society ruled by law, the legal consciousness of Chinese citizens is gradually increasing, and the enthusiasm of the public to participate in public affairs is also increasing. And with the advent of the information age, the public's demand for information has increased significantly, and the access to it has also increased significantly. As a result, the concept of the right to know began to enter the public opinion, and became more and more popular. The public's requirement for the transparency of information, especially the public information, made the system of information public emerge as the times require. In May 2008, China promulgated the regulations on Government Information Disclosure, which requires the administrative organs to implement the Information Disclosure system. On the basis of its publicity, and as a public enterprise and institution in the field of education, colleges and universities should also bear the obligation of information disclosure, which was stipulated in the measures for the implementation of Information Disclosure in Colleges and Universities promulgated by the Ministry of Education in April 2010. However, as a new thing, college information disclosure has encountered difficulties and challenges in practice, which has aroused scholars' attention and discussion. Based on the basic concepts and theories of information disclosure in colleges and universities in China, this paper reveals the present situation and problems of information disclosure in colleges and universities through literature research and empirical investigation, and puts forward corresponding suggestions and expectations for improvement. In addition to the introduction and conclusion, this paper is divided into four parts: the first chapter is the basic concept and historical evolution of information disclosure in colleges and universities in China. Through the concept analysis, this chapter expounds the definition of colleges and universities, the connotation of university information and the particularity of university information disclosure. It also combs the history of information disclosure in colleges and universities and sums up the differences between information disclosure and school affairs disclosure in order to show that our country has formally implemented the system of information disclosure in colleges and universities. The second chapter is the basic theory of information disclosure in colleges and universities in China. Colleges and universities have been regarded as the obligatory subject of information disclosure in our country, so it is necessary to sort out the basic theory of information disclosure in colleges and universities in order to understand the system of information disclosure in colleges and universities fundamentally. Starting from the analysis of the legal status of institutions of higher learning, this chapter expounds the legal status of colleges and universities in the field of information disclosure, and reveals the theoretical basis of information disclosure in colleges and universities-the publicity of institutions of higher learning and the right of the public to know. The third chapter is about the present situation and existing problems of information disclosure in colleges and universities in China. The construction of information disclosure system in colleges and universities in China is still in progress, and some achievements have been made, but there are still many problems, such as the weak awareness of information disclosure in colleges and universities. The deficiency of legislation and the difficult balance between the autonomy of running a school and the disclosure of information in colleges and universities. The existence of these problems makes the work of information disclosure in colleges and universities far from meeting the expectations of the public. The fourth chapter is the perfection of information disclosure in colleges and universities of our country. In response to the questions raised in Chapter III, this chapter proposes effective measures, such as internal construction and external support, balancing the disclosure of information and autonomy in running schools, promoting the disclosure of key information, and perfecting the relevant system of the measures, To build and perfect the information disclosure system in colleges and universities of our country.
