政府信息公开过程中的个人隐私保护

【摘要】：政府信息公开是对公众知情权的支持与维护,是实现现代政府管理目标的重要保障,是政府提供社会服务的基本方式。理论上,政府对于个人隐私信息的公开是为了公共利益的需要合理的牺牲个人隐私的利益。但实践中,政府往往无法保证按照其收集信息的目的利用信息,也无法保证其保存的个人隐私信息的绝对安全,甚至利用“个人隐私”的可裁量性,维护自身的利益。在这种情况下,个人的隐私权益往往受到侵害,成为所谓的“透明人”。因此,界定个人隐私的范围,制定相应的法律保护制度便显得尤为迫切。本文运用实证分析法、比较分析法等方法对政府公开中的个人隐私保护存在的主要法律问题和理论困惑作了较为细致的分析与研究,并在此基础上,就如何协调政府信息公开与个人隐私保护从基本理念、具体制度等方面提出建议,希望能对解决政府信息公开与个人保护保护两者之间的冲突有所助益。公民的知情权和隐私权的保护是我们国家尊重和保障人权的重要体现,政府在贯彻和落实其行政职能的过程应当体现出公民隐私权和知情权的重要价值。假如在政府信息公开过程中对二者的保护不能做到统筹兼顾,不能做到全面协调,那么我国公民的基本人权必然会面临着相当严重的威胁。本文通过对个人隐私立法现状和司法案例的的研究,发现现阶段个人隐私保护存在的具体问题,并分析问题形成的原因。揭示了个人隐私保护与政府信息公开的内在冲突,并从公法与私法的角度分析了个人隐私的内涵,针对立法和实践中存在的问题,提出了相应的建议。并尝试着在政府信息公开的过程中明确个人隐私的内涵和外延,来解决政府信息公开与个人隐私保护的冲突。
[Abstract]:Government information disclosure is the support and maintenance of the public's right to know, is an important guarantee to realize the goal of modern government management, and is the basic way for the government to provide social services. In theory, the disclosure of personal privacy information by the government is for the sake of public interest at the reasonable expense of personal privacy. However, in practice, the government can not guarantee the use of information according to the purpose of collecting information, nor can it guarantee the absolute security of the personal privacy information it preserves, and even make use of the discretion of "personal privacy" to safeguard its own interests. In this case, the privacy rights of individuals are often infringed and become so-called "transparent person". Therefore, it is particularly urgent to define the scope of personal privacy and establish the corresponding legal protection system. This paper makes a detailed analysis and research on the main legal problems and theoretical puzzles existing in the protection of personal privacy in government disclosure by using the methods of empirical analysis and comparative analysis, and on this basis, This paper puts forward some suggestions on how to coordinate the disclosure of government information and the protection of personal privacy from the aspects of basic concepts and specific systems in the hope that it can help resolve the conflict between the disclosure of government information and the protection of individuals. The protection of citizens' right to know and privacy is an important embodiment of our country's respect and protection of human rights. In the process of carrying out and carrying out its administrative functions, the government should embody the important value of citizens' right to privacy and the right to know. If the two protection in the process of government information disclosure can not be integrated and coordinated, then the basic human rights of our citizens will inevitably face quite serious threats. Through the study of the current situation of personal privacy legislation and judicial cases, this paper finds out the specific problems existing in the protection of personal privacy at this stage, and analyzes the reasons for the formation of the problems. This paper reveals the internal conflict between the protection of personal privacy and the disclosure of government information, analyzes the connotation of personal privacy from the angles of public law and private law, and puts forward some suggestions for the problems existing in legislation and practice. In order to resolve the conflict between government information disclosure and personal privacy protection, we try to clarify the connotation and extension of personal privacy in the process of government information disclosure.
