济南市行政执法电子监察研究

【摘要】：法律的生命在于实施。加强对行政执法行为的监督,是确保法律正确实施的重要途径,是规范执法权力运行的必要环节,是维护相对人合法权益、营造良好经济发展环境的有力手段。在信息技术飞速发展和电子政务席卷全球的背景下,如何利用现代技术手段进一步加强对行政执法行为的监督,提高其严格、规范、公正、文明程度,克服传统监督存在的漏监、虚监、弱监等弊端,是全面依法治国新形势下进一步推动行政执法监督体制机制改革的内在要求,是如期建成法治政府新要求下促进行政执法监督措施创新的重要方法。济南市为规范行政执法行为、营造良好发展环境,2010年开始部署建设行政执法电子监察工作。本文以济南市行政执法电子监察工作为研究对象,以行政执法监督为视角,综合运用文献法、访谈法等社会科学的分析、研究方法,通过详细总结电子监察系统的监督内容、监督制度、作用机理、推进模式、建设路径等,归纳出行政执法电子监察工作推进中的共性内容,为推进其运用提供经验。同时,在与传统行政执法监督方式的对比中,总结出电子监察监督内容全、监督时段长、监督效率高、监督效果好等方面的比较优势,为规范权力运行提供新的思路和途径,为强化执法监督创建更有效的模式范本。在文章的最后,分析出济南市行政执法电子监察工作中存在的网络不统一、覆盖不全面、应用不到位、功能不完善等问题,分析其在观念、体制、制度、技术等方面的产生原因,提出了理顺工作体制、扩充系统容量、加强技术研发、完善制度体系、融入统一平台的建议和措施。以往对电子监察的研究集中于效能监督和廉政监督两个方面,执法监督方面进行的研究是一个空白。本文以行政执法监督为视角对电子监察进行研究,弥补以往研究的缺失,拓展研究领域。在分析总结中,一方面在理论上形成了较为成形的研究结果,填补了济南市行政执法电子监察工作方面的研究空白,另一方面在实践中通过分析问题和提出优化建议,为济南市行政执法电子监察工作查缺补漏,为其可持续发展提供动力。
[Abstract]:The life of the law lies in its enforcement. Strengthening the supervision of administrative law enforcement is an important way to ensure the correct implementation of law, a necessary link to standardize the operation of law enforcement power, and a powerful means to safeguard the legitimate rights and interests of the relative person and to create a good environment for economic development. Under the background of the rapid development of information technology and e-government sweeping the world, how to further strengthen the supervision of administrative law enforcement by means of modern technology and improve its strict, standardized, fair and civilized degree, Overcoming the shortcomings of traditional supervision, such as missed supervision, false prison and weak prison, is the inherent requirement to further promote the reform of the system and mechanism of administrative law enforcement supervision under the new situation of ruling the country according to law in an all-round way. It is an important method to promote the innovation of administrative law enforcement supervision measures under the new requirements of the government under the rule of law. In order to standardize the behavior of administrative law enforcement and create a good development environment, Jinan City began to deploy the construction of electronic supervision of administrative law enforcement in 2010. Taking the electronic supervision of administrative law enforcement in Jinan as the research object, from the perspective of the supervision of administrative law enforcement, this paper comprehensively applies the analysis and research methods of social sciences such as literature method, interview method and so on, and summarizes the supervision contents of the electronic supervision system in detail. Supervision system, action mechanism, promotion mode, construction path, etc., summed up the common content of the electronic supervision work of administrative law enforcement, and provided experience for promoting its application. At the same time, in the comparison with the traditional administrative law enforcement supervision, it summarizes the comparative advantages of electronic supervision and supervision, such as full content, long supervision period, high supervision efficiency, good supervision effect, and so on, which provides a new way of thinking and way for standardizing the operation of power. Create more effective model for strengthening law enforcement supervision. At the end of the article, the author analyzes the problems existing in the electronic supervision of administrative law enforcement in Jinan, such as the network is not unified, the coverage is not comprehensive, the application is not in place, the function is not perfect, and so on, and analyzes its concept, system, and so on. Some suggestions and measures are put forward to rationalize the working system, expand the capacity of the system, strengthen the research and development of technology, perfect the system and integrate into the unified platform. In the past, the research on electronic supervision focused on efficiency supervision and clean government supervision, and the research on law enforcement supervision was a blank. This paper studies the electronic supervision from the perspective of administrative law enforcement supervision to make up for the lack of previous research and expand the research field. In the analysis and summary, on the one hand, a relatively formed research result has been formed in theory, which fills up the research gap in the electronic supervision of administrative law enforcement in Jinan, on the other hand, through the analysis of problems and the suggestion of optimization in practice, For Jinan administrative law enforcement electronic supervision work to fill gaps and provide impetus for its sustainable development.
