政府信息公开中“内部信息”的认定标准

【摘要】：政府信息公开对保护公民的行政知情权、促进民主政治、推进行政工作透明度、防止腐败等具有深远的意义。《政府信息公开条例》颁布以后我国在政府信息公开方面取得了长足的进步,但也存在很多问题,尤其是行政机关常常以"内部信息""为挡箭牌拒绝公开某些政府信息。本文试图从申请内部信息公开的诉讼案例为出发点,结合法律法规和司法实践,理清"'内部信息"范畴,并为审查'内部信息"提供判定思路。本文大致分为三个部分。第一部分主要阐述了论文的选题背景、研究现状与方法以及研究论文的目的和意义。第二第三部分通过归纳部分地区有关"内部信息"公开案例数据以及探讨典型案例中主要争议点,指出我国现阶段在""内部信息"不予公开上存在的主要问题,即"内部信息"司法审查缺乏统一的认定标准。第四部分,针对'内部信息"缺乏统一认定标准现象介绍了国外的成熟规则,以及结合我国学者对"内部信息"认定上的学术观点,总结出了政府信息公开案件中"内部信息"的认定标准。
[Abstract]:The disclosure of government information will protect citizens' administrative right to know, promote democratic politics, and promote transparency in administrative work. The prevention of corruption is of far-reaching significance. After the promulgation of the regulations on the publicity of Government Information, China has made considerable progress in the field of government information disclosure, but there are also many problems. In particular, the administrative authorities often use "internal information" as a shield to refuse to disclose certain government information. This paper attempts to clarify the category of "internal information" from the point of view of litigation cases applying for the disclosure of internal information, combining laws and regulations and judicial practice, and to provide a judgment train of thought for the examination of "internal information". This paper is roughly divided into three parts. The first part mainly describes the background of the thesis, the research status and methods as well as the purpose and significance of the research paper. In the second part, the third part points out the main problems existing in "internal information" in China at the present stage by summarizing the data of "internal information" public cases in some areas and discussing the main controversial points in typical cases. That is, the judicial review of "internal information" lacks a unified identification standard. In the fourth part, according to the phenomenon of lack of uniform identification standard of 'internal information', this paper introduces the mature rules of foreign countries, and combines the academic viewpoint of Chinese scholars on the identification of "internal information". This paper summarizes the identification standard of "internal information" in the case of government information disclosure.
