互助与自足:土地复垦监管的共同体关系及功能

【摘要】：基于共同体理论对土地复垦监管展开方法论层面的本源式研究,有助于重构相关监管机制的理念模式,以实现对既存现实问题的整全性校正。土地复垦监管共同体是一种存续于土地复垦领域,以有效解决相关监管机制中各类具体问题的共同社会治理生活。其成就与否,往往取决于共同体所特有的关系属性、功能属性能否在土地复垦监管中彰显出来。该类共同体应具备的互助性关系属性往往通过共同体成员之间的互助,以及共同体与其成员之间的互助而显现出来;当基于其互助性关系属性来诠释土地复垦监管法律关系的主体、客体及内容。该类共同体应具备的自足性功能属性往往通过共同体系统调整功能与纠纷解决功能的自足性而显现出来;当基于其自足性功能属性来调整土地复垦监管规范设定理念,并就相关规范设定中不够周延的相应主体规范、权属规范、保证金规范来予以充实。
[Abstract]:The research on the methodology of land reclamation supervision based on the community theory is helpful to reconstruct the conceptual model of the relevant supervision mechanism and to achieve the overall correction of the existing practical problems. The Community of Land Reclamation Supervision is a kind of common social governance which exists in the field of land reclamation to effectively solve various specific problems in the relevant regulatory mechanism. Its achievement or not often depends on the special relationship attribute of the community, and whether the function attribute can be shown in the land reclamation supervision. This kind of community should have the mutual assistance relationship attribute often through the community member mutual assistance, as well as the community and its member mutual aid and show; The subject, object and content of the legal relationship of land reclamation supervision are interpreted on the basis of its mutual aid relationship attribute. The self-sufficiency function attribute that this kind of community should have is often shown through the self-sufficiency of the community system adjustment function and dispute resolution function; When based on its self-contained function attributes to adjust the concept of land reclamation regulatory norms, and the relevant norms of the relevant norms are not long-term corresponding subject norms, ownership norms, margin norms to enrich.
