行政法上举报人保护制度研究

【摘要】:在我国国情下,举报人是指向有关公共权力机关检举、报告、揭发国家机关及其工作人员的违纪、违法、犯罪行为的公民、法人和其他组织。在力行反腐的时代背景下,强调举报作为公权力行使的有效监督手段有利于国家反腐事业的顺利进行。在举报人保护方面,举报受理及主管机关对举报人承担保护义务和责任,鉴于现阶段公权力行使的不规范性,行政法上举报人保护制度的重点应为:对检举揭发公权力违规违法行使的举报人进行法律保护,以及对公权力机关不依法履行保护义务的法律规制;对举报人进行保护的责任主体为公权力机关,保护的客体为举报人的自由权利和国家安定的权力秩序。相较于举报人的行政法保护,司法保护已经相对完善,所以从行政法的角度构建举报人保护制度非常必要。应当从举报人、保护机关这两个主体出发,构建以信息保护、人身保护、权利救济为重点,,举报人和保护机关双向互动的保护体系,并推动举报人保护制度的法律实践。
[Abstract]:Under the national conditions of our country, the informant refers to the citizens, legal persons and other organizations who point to the relevant public power organs to report, report and expose the disciplinary, illegal and criminal acts of state organs and their functionaries. In the era of anti-corruption, emphasizing that reporting as an effective means of monitoring the exercise of public power is conducive to the smooth progress of the national anti-corruption cause. With regard to the protection of whistle-blowers, the acceptance of the report and the responsibility of the competent authority for the protection of the informant, in view of the irregularity of the exercise of public power at the present stage, The emphasis of the whistle-blower protection system in administrative law should be as follows: legal protection of whistle-blowers who expose the illegal exercise of public power and the legal regulation of the failure of public power organs to perform their protection obligations according to law; The main body of responsibility for protecting the whistle-blower is the public power organ, and the object of protection is the whistleblower's free right and the stable power order of the country. Compared with the protection of the whistleblower's administrative law, the judicial protection has been relatively perfect, so it is necessary to construct the whistle-blower protection system from the angle of administrative law. It is necessary to construct a two-way interactive protection system based on the protection of information, personal protection and right relief, and to promote the legal practice of the whistleblower protection system from the perspective of the whistle-blower and the protection organ.
