法律视角下休闲体育权利研究分析

【摘要】：休闲体育作为社会新兴并迅速发展的运动,日益受到大众的追捧,作为体育人文社会科学的新领域,西方国家很多专家学者特别重视休闲体育,建立了专门研究休闲体育的机构,培养组织实施休闲体育的人才。目前,我国国民已经具有享受休闲体育活动的经济基础,如何使大众拥有一个良好的休闲体育活动大环境,这是我国发展休闲体育的阶段性目标。参加休闲体育是人的一项基本权利,是与休息、睡眠同等重要的权利,它已成为当今社会人们精神生活的重要组成部分。然而,这一权利常常被忽视、被践踏、被挤占的事情时有发生,因此,随着人们对健康生活质量需求的进一步增强,加强休闲体育权利研究成为休闲体育研究领域的一项重要工作。开展休闲体育权利研究,是推进体育事业的发展,推进我国大众健康高质量生活的重要途径。本文把休闲体育权利的透视作为第一个问题进行研究。通过解释休闲体育权利的属性、本质和要素对休闲体育权利做一个完整的诠释。其中从利益、意志自由、正当性和确认保障四个要素入手,详细分析休闲体育权利,通过自由说、意志说、利益说和合理期望说对休闲体育权利本质进行分析,对于休闲体育活动参与者与其他利益人的一些并未实际解决的问题入手做一些理论分析。从人权视角下对休闲体育权利进行分析定位,是本文构成的第二部分。对人的基本权利健康权、休息权和追求幸福的权利三者入手进行分析,然后对于休闲体育权利与幸福权之间的关系进行梳理。休闲体育权利的研究、休闲体育的研究归根结底是为了大众的幸福而进行的研究。从人权视角下对四者进行解读、研究和梳理。对于休闲体育权利的实证分析,通过现实中比较有代表意义的4个案例对于休闲体育活动中存在的有关权利归属问题,对于休闲体育参与人的利益与他人利益、休闲体育参与人与权利的法定性以及法律尚未明确的权利是否为权利进行了展开分析。最后一个部分是对于我国休闲体育权利保障问题提出部分建议,对于休闲体育事业发展提出了建议,即拓展休闲体育参与者的权利空间、完善休闲体育参与者维权机制、健全休闲体育权利社会保障机制以及大力宣传休闲体育权利,同时对于休闲体育参与者提出了保障自身权利同时认可他人权利的意见。本文旨在能够从法律的视角中对休闲体育权利做出实证分析研究,能够为将来蓬勃发展的休闲体育活动起到规范作用,能够更好地保障休闲体育活动的进行,争取能为我国的体育事业发展做出一点贡献。
[Abstract]:Leisure sports, as a new and rapidly developing sport in society, has been increasingly sought after by the public. As a new field of sports humanities and social sciences, many experts and scholars in western countries attach special importance to leisure sports. Established specialized research leisure sports organization, trains the organization to carry out the leisure sports talented person. At present, Chinese people already have the economic base to enjoy leisure sports activities, how to make the public have a good leisure sports environment, which is the stage goal of the development of leisure sports in our country. Participation in leisure sports is a basic right of human beings, and it is as important as rest and sleep. It has become an important part of people's spiritual life in today's society. However, this right is often ignored, trampled on and squeezed from time to time, so as the demand for a healthy quality of life increases further, Strengthening the study of leisure sports rights has become an important work in the field of leisure sports research. The research on leisure sports rights is an important way to promote the development of sports and promote the healthy and high quality life of the public in our country. This paper studies the perspective of leisure sports rights as the first problem. By explaining the attribute, essence and elements of leisure sports rights, this paper makes a complete interpretation of leisure sports rights. Starting with the four elements of interest, freedom of will, legitimacy and confirmation of protection, this paper analyzes the right of leisure sports in detail, and analyzes the essence of the right of leisure sports through the theory of freedom, the theory of will, the theory of interest and the theory of reasonable expectation. This paper makes some theoretical analysis on some unsolved problems between leisure sports participants and other stakeholders. From the perspective of human rights, the analysis and positioning of leisure sports rights is the second part of this paper. This paper analyzes the basic rights of human beings to health, the right to rest and the right to pursue happiness, and then combs the relationship between the right to leisure sports and the right to happiness. The study of leisure sports rights, leisure sports research in the final analysis is for the happiness of the public. From the perspective of human rights to interpret, study and sort out the four. For the empirical analysis of leisure sports rights, through the four cases of more representative significance in reality, for the rights of leisure sports activities, for the interests of leisure sports participants and the interests of others, The legal nature of leisure sports participants and rights and whether the rights that have not yet been clearly defined by law are analyzed. The last part puts forward some suggestions on the protection of leisure sports rights in our country, and puts forward some suggestions for the development of leisure sports, that is, expanding the right space of leisure sports participants and perfecting the mechanism of safeguarding the rights of leisure sports participants. We should improve the social security mechanism of leisure sports rights and vigorously publicize leisure sports rights. At the same time, we put forward some suggestions for leisure sports participants to protect their own rights and recognize the rights of others at the same time. The purpose of this paper is to make empirical analysis and research on leisure sports rights from the perspective of law, to play a normative role in the future vigorous development of leisure sports activities, and to better ensure the development of leisure sports activities. Strive to make some contributions to the development of sports in our country.
