论新闻传播法律制度构建

【摘要】：由于移动互联网科技的迅猛发展,新闻传播事业登上了一个新的高度,新闻传播活动已经成为人们日常生活中的一部分,我国的新闻事业也迎来一个崭新的春天。与此同时,与新闻传播相关的法律、法规从我国的根本大法的《宪法》到地方颁布的出版规定,已经初步形成了一套新闻传播的法律体系,尤其是前新闻出版总署署长柳斌杰透露,中央已经开始着手研究制定《新闻传播法》,这也为我国社会主义新闻传播法律制度的构建增强了信心。虽然目前新闻传播领域的法律体系已经初具规模,但仍存在着新闻传播行业发展的外部法律环境不成熟、以及新闻从业者自身的权利需要保障时无法可依的尴尬局面。一方面是监管媒体的行政部门以个人主观判断向媒体发号施令;另一方面由于缺乏有效的法律,媒体有偿新闻、有偿不闻现象层出不穷。在笔者看来,要想调整好新闻传播活动中的各种关系,依靠一部《新闻传播法》的制定和颁布就能完全解决也不现实,只有构建出完善的新闻传播法律制度才能新闻传播活动走向正轨。单纯从新闻传播立法的角度来看,上世纪八十年代初期新闻界及法学界的专家就开始联手研究制定方案,当时中央政府也曾组织研究新闻立法,但是风风雨雨这么多年,新闻立法还只是停留在研究上。由于一些根本性的问题目前难以一下子解决,业内人士对新闻立法怎么“立”还有争论。在笔者看来,与其坐等立法,不如就现有的与新闻传播相关的法律法规做一个梳理,分析我国新闻传播法律制度构建的现状与问题,从而探讨构建我国新闻传播法律制度的未来发展走向,毕竟,完善的新闻传播法律制度是我国新闻传媒行业走向良性发展根本保证。
[Abstract]:With the rapid development of mobile Internet technology, news communication has reached a new height. News communication activities have become a part of people's daily life, and the news industry in our country has also ushered in a new spring. At the same time, laws and regulations related to news dissemination, from the Constitution of the fundamental laws of our country to the publishing provisions promulgated by the local authorities, have initially formed a set of legal systems for news dissemination. In particular, Liu Binjie, a former director of the General Administration of Press and publication, revealed that the central government has begun to study and formulate the "News Communication Law," which has also strengthened confidence in the construction of the socialist news communication legal system in China. Although the current legal system in the field of news communication has begun to take shape, there is still an awkward situation in which the external legal environment for the development of the news communication industry is immature, and the rights of news practitioners can not be guaranteed when their own rights need to be guaranteed. On the one hand, the administrative departments that supervise the media issue orders to the media with personal subjective judgment; on the other hand, due to the lack of effective laws, the media paid news, paid news phenomena emerge in endlessly. In my opinion, in order to adjust the various relations in news communication activities, it is unrealistic to rely on the formulation and promulgation of a News Communication Law. Only by constructing a perfect legal system of news communication can news communication activities move on the right track. From the point of view of news and communication legislation, experts from the press and legal circles began to work together to study and formulate plans in the early 1980s. At that time, the central government also organized the study of news legislation, but for so many years, News legislation is still only in the study. Because some fundamental problems are difficult to solve at once, industry insiders still argue about how to "enact" news legislation. In the author's opinion, instead of waiting for legislation, it is better to sort out the existing laws and regulations related to news communication, and analyze the present situation and problems of the construction of the legal system of news communication in our country. In order to explore the future development trend of constructing the legal system of news communication in our country, after all, the perfect legal system of news communication is the fundamental guarantee for the benign development of the news media industry in our country.
