《中医药法》立法与实施相关问题探讨

【摘要】：目的:通过对《中医药法》立法背景的总结,结合国外中医药立法进展,指出中医药立法及实施困境,提出建立和完善中医药法律体系的建议。方法:以中医药立法热点为视角,运用文献调查方法及比较分析的方法,梳理近年国内研究中医药立法及实施的相关文献和最新中医药事业发展状况,以及国外对中医药立法保护及监管的最新进展。结果与结论:中医药法制化欠缺特点,中医药的认可度仍然较低,中医药知识产权保护缺失,中医药走出国门遭遇技术壁垒。《中医药法》是解决中医药发展体系众多问题新的突破,中医药立法及实施将日趋完备。
[Abstract]:Objective: to summarize the legislative background of traditional Chinese Medicine Law, combined with the legislative progress of traditional Chinese medicine in foreign countries, point out the predicament of legislation and implementation of traditional Chinese medicine, and put forward some suggestions for establishing and perfecting the legal system of traditional Chinese medicine. Methods: from the perspective of the hot spot of traditional Chinese medicine legislation, using the methods of literature investigation and comparative analysis, this paper combs the relevant literature on the legislation and implementation of traditional Chinese medicine in recent years and the latest development of traditional Chinese medicine, as well as the latest progress in the protection and supervision of traditional Chinese medicine legislation in foreign countries. Results & conclusion: the lack of legalization of traditional Chinese medicine, the lack of recognition of traditional Chinese medicine, the lack of intellectual property protection of traditional Chinese medicine, and the technical barriers encountered by traditional Chinese medicine outside the country. The Law of traditional Chinese Medicine is a new breakthrough to solve many problems in the development system of traditional Chinese medicine, and the legislation and implementation of traditional Chinese medicine will become more and more complete.
