农民住房财产权论析——寻找政策与法律的契合

【摘要】：源生于政策的农民住房财产权不能在既存的法律体系中找到直接对应,却可在其间寻觅相应的契合点,即农民住房财产权是由宅基地使用权和农村房屋所有权有机结合而成。农民住房财产权的倡设是为了实现相关权利身份性的突破和财产性的彰显,这种制度调整有其必要性和可行性,以农民住房财产权统合宅基地使用权和农村房屋所有权,有利于达成制度改革目标,需要以必要住房财产权和剩余住房财产权的区分为基础进行制度设置。
[Abstract]:The farmers' housing property rights, which originated from the policy, can not find a direct correspondence in the existing legal system, but can find the corresponding meeting point during them, that is, the farmers' housing property rights are formed by the organic combination of the right to use the homestead and the ownership of the rural houses. The initiative of farmers' housing property rights is to realize the breakthrough of the identity of related rights and the manifestation of property. It is necessary and feasible to adjust this system. The integration of farmers' housing property rights with the right to use homestead and the ownership of rural houses is conducive to achieving the goal of system reform. It is necessary to set up the system on the basis of the distinction between essential housing property rights and surplus housing property rights.
